Most of the burning now is happening in fields tucked away in the villages.Stubble burning is yet to pick up in Punjab, says Sardar Harinder Singh Lakhowal, a farmer in Ludhiana district. Late rains have delayed harvesting. But farmers such as Lakhowal also say government subsidies won’t help. “In my area, there are only about 1-2 machines to remove stubble per village. Renting them will add around `5,000 per acre to our paddy harvesting cost.” For the ban on stubble burning to be effective, he says, the central government should pay Rs 200 per quintal as compensation to farmers.“The machines that clear stubble, such as rotavators, are very expensive,” says Lakhowal. “Since the centre and state announced subsidies on them, the manufacturers have hiked prices.”State government agencies continue to be hopeful their steps will tackle stubble burning and pollution this year. “We are continuously monitoring the ambient air quality across Punjab,” says SS Marwaha, chairman of the state pollution control board. “So far this year, we have got reports of less burning incidents from across Punjab. The state agriculture department is working with us. We are certain that over the next couple of weeks, there will be much less stubble burning.”The state agriculture department and the Punjabi University, Patiala, have deployed 8,000 volunteers to check burning in villages and to educate farmers. Sarpanchs and farmers in 4,000 villages have already been sensitised, say officials.Today, more farmers are aware of the environmental risks of stubble burning, says BS Dhillon, the vice-chancellor of Punjab Agricultural University in Ludhiana. “We have been trying very hard by campaigning in villages and training farmers. Though a change will not happen in one season, things will get better,” he adds.There is a long way to go before stubble burning is completely eliminated, says Tejpal Singh, general manager of Mansa-based power plant Viaton Energy, but this could be a better year than the previous one. The 10 MW thermal power plant he heads uses crop residue to generate power. “We have a target to collect over 70,000 tonnes of paddy residue for our plant this year compared with 55,000 tonnes in 2017.” However, he warns, unless the issue of change in cropping pattern, with less dependency on paddy, is addressed, the problem will linger. Six power plants in the region used 4.5 lakh tonnes of paddy straw last year as raw material.Farmers in some villages seem to have realised the danger of crop burning. Ranvir Singh, an ex-serviceman who farms on two and a half acres in Karor village, Rohtak district, in Haryana, has not burnt stubble for the past couple of years. He is working with panchayat members in his village to spread awareness against the practice.It is undoubtedly an embarrassment for India when the capital and its adjoining areas are covered with grey smoke for weeks, as has happened in the recent past. Perhaps the pall of smoke will abate this year.

I fall sometimes. I drop things. My memory is foggy. And my left side is asking for directions from a broken gps. But we are doing it . And I laugh and I don¿t know exactly what I will do precisely but I will do my best. Since my diagnosis at ten thirty pm on The night of August 16, I have had love and support from my friends , especially @jaime_king @sarahmgellar @realfreddieprinze @tarasubkoff @noah.d.newman . My producers #noreenhalpern who assured me that everyone has something. #chrisregina #aaronmartin and every crew member... thank you. I am in the thick of it but I hope to give some hope to others. And even to myself. You can¿t get help unless you ask. It can be overwhelming in the beginning. You want to sleep. You always want to sleep. So I don¿t have answers. You see, I want to sleep. But I am a forthcoming person and I want my life to be full somehow. I want to play with my son again. I want to walk down the street and ride my horse. I have MS and I am ok.   • A drive along the National Highway 44, which stretches from Srinagar to Kanyakumari, would normally showcase the countryside in all its colourful glory. Last week, however, a drive down some of the highway’s stretches in Punjab, Haryana and Delhi had as its backdrop an apocalyptic horizon of grey, foretelling what’s in store this winter for residents in much of north India â€" a spell of deadly air pollution that will blow past all safety limits, exposing millions to air that is too foul to breathe.
  • Smoke from burning of crop residue â€" the stubble left in farms after mechanised harvesting â€" was starting to envelop the skies. Governments in Punjab, Haryana and the centre have adopted several measures to mitigate the stubble burning after two preceding winters of terrible air pollution. But conversations with farmers on the ground reveal neither the fear of penalties nor the lure of subsidies are having an impact. They need to clear their farms quickly and cost effectively to sow the more important wheat crop. And burning the paddy stubble is what they plan to do. In some farms this reporter witnessed stubble being burned even as cops were standing around. Taking on the powerful lobby of farmers is not something most politicians in Punjab or Haryana will have appetite for, much less a beat constable.
  • Stubble burning is episodic and seasonal and depends on wind speed and direction; and though there are no clear estimates, it contributes significantly towards the air pollution in north India every winter, says Anumita Roy Chowdhury, executive director research and advocacy, Centre for Science and Environment. “While the central government has provided funds for subsidised machines to farmers for in situ tackling of the stubble; it is up to the state governments to take steps to ensure that throughout the harvesting season from end-October to mid-November the situation is closely monitored,” she adds.The air quality in Delhi-NCR had already seen a dip the previous week, setting off a flurry of political signalling. The Delhi government’s emergency plan to tackle air pollution came into force and Punjab Chief Minister Captain Amarinder Singh asked the Centre to offer farmers compensation to not burn their crop stubble, at the rate of Rs 100 a quintal.
  • While Punjab has always been a hub of wheat cultivation, paddy is a relatively recent entrant that is riding on the back of attractive minimum support price being offered by the government. Farmers must clear vast fields within a couple of weeks after the paddy harvest to prepare ground for the cultivation of wheat, their more important crop.Mechanised harvesting has made the process swifter but the machines leave about 2 feet of paddy stalks on the field. While wheat stubble is easily converted into cattle fodder, converting paddy crop residues to fodder is not as viable. To clear the fields, farmers in Punjab start burning the residue on fields across 41,45,000 hectares in October-November. The thick ensuing smoke envelops the whole region.
  • The Haryana govt has said it is taking steps to ensure crop burning is not widespread. It imposed a fine of Rs 2,500 per incident on farmers caught burning crop residues. But that does not worry Suresh, a contractor who threshes grains for farmers. But what about the crop stubble on the ground? “If we don’t set fire to this right here, someone else will. After all this has to be disposed of,” says Suresh, refusing to give his second name.Burning seems inevitable, despite government penalties. “Local police come and check a few times. We pay the penalties. But even that is cheaper than buying or renting expensive equipment to clear the stubble,” Suresh adds.
  • Haryana, which has 84,000 hectares of farmlands, has collected a measly Rs 4,30,000 as stubble burning fines this year. “But we are continuously monitoring the situation and the chief secretary has already had three review meetings since the paddy harvesting season started,” says S Narayanan, member-secretary, Haryana State Pollution Control Board. “Satellite data from the Haryana Space Applications Centre show a 40% decrease in smoke from stubble burning over the same period last year.”In the district of Karnal, Mahtab Kadyan is dismissive of the government’s measures. The district convenor of the state unit of the Bharat Kisan Union, who also owns 100 acres of farmland, says: “The package announced by the government is making very little difference, especially for farmers with small landholdings. The cost of machines to remove residue, even with subsidies, and diesel will inflate harvesting cost. Most landholdings here are below two hectares and farmers are already burdened with debt.” The problem can be solved if electricity companies pick up the stubble (for use as biomass for power generation) directly and pay compensation to the farmers, says Kadayan.
  • Swiss bank UBS AG is seeking to evict indebted ex-Kingfisher tycoon Vijay Mallya, his mother and son from their swish multi-million-pound mansion overlooking Regent’s Park in London. The bank has applied for possession of the property in the UK High Court, the country’s third highest court, on grounds that the mortgage has expired and not been repaid. UBS’s claim against Rose Capital Ventures Ltd, Vijay Mallya, mother Lalitha Mallya and son Sidhartha Mallya, in the business and property court of the High Court, will be heard on October 24. Rose Capital Ventures Ltd took out a five-year interest only mortgage on the property with UBS in March 2012 for £20.4 million (Rs 195 crore). Mallya, his mother and son live here and are beneficiaries of the trust, UBS states. The shares in Rose Capital are owned by Gladco that is owned by the Sileta trust, a Mallya family trust, Mallya confirms in his defence. Despite the loan’s expiry and the claimant’s request that defendants vacate the property, the defendants have refused to move out, UBS states in its claim.The leasehold property â€" 18 and 19 Cornwall Terrace â€" was purchased by Rose Capital and incorporated in the British Virgin Islands on October 3, 2005, for £5.4 million (Rs 52 crore). Freehold rights to the property belong to the Crown Estate, namely the Queen, as per the title deeds. UBS also seeks Rose Capital pay the loan’s outstanding and wants the court to declare that the defendants are not entitled to enter or remain on the property. The amount owed as of September 1, 2017, is £20,718,236 (Rs 198 crore), the bank has alleged. The claim states that UBS terminated the loan early on June 9, 2016. Since the loan was not repaid, the bank appointed receivers who started proceedings against the four defendants and housekeeper for the property’s possession in November 2016. Following a June 2017 court order, the housekeeper vacated, UBS states. Since the mortgage expired on March 26, 2017, and the outstanding balance on that date of £20.4 million was still not paid, the proceedings by the receiver were stayed, and the bank decided to bring proceedings to take possession of the property and to sell it, UBS states. An attempt to refinance the loan with CBH Bank by Rose Capital collapsed and “as far as the claimant knows, there are no other potential refinancing options for Rose Capital,” the claim states. Barrister Jonathan Gavaghan, of Blake Morgan LLP representing the defendants, denies that UBS has the right to the property. They state Rose Capital had continued to make the interest payments as required and that UBS has not given any legitimate reason for calling in the debt early. They have called UBS’s claim a breach of mortgage terms. Gavaghan said Mallya had been “orally assured” by Gautam Kumar at UBS that the loan would be “rolled over on the expiry of the five-year term” and “extended to at least a 10-year period” and that Rose Capital took the loan basis this. He also said bringing this claim while the other claim was stayed was “abuse of process” and UBS had “delayed or obstructed” the refinancing for the property. The HC has subsequently issued an order stating that “Blake Morgan LLP has ceased to act as the solicitors for the defendants” and “the court record shall show that the defendants now act in person.” A five-day trial is scheduled for May 2019.
  • Several laws and regulators are converging on the hotbutton topic of data localisation. The deadline for a Reserve Bank of India (RBI) mandate for fintech firms to house data only in India lapsed last week. Other norms around holding accounting data dating back to 2014 locally, the draft ecommerce law that requires firms to locally store “community data collected by Internet of Things devices in public space” and “data generated by users in India from various sources including e-commerce platforms, social media, search engines, etc,” only queer the pitch further. What’s At Stake There’s a massive explosion in data being generated by connected internet users in India. According to a report by real estate and infrastructure consultancy Cushman and Wakefield, the size of the digital population in India presents a huge potential demand for data centre infrastructure. Digital data in India was around 40,000 petabytes in 2010; it is likely to shoot up to 2.3 million petabytes by 2020 â€" twice as fast as the global rate. If India houses all this data, it will become the second-largest investor in the data centre market and the fifth-largest data centre market by 2050, the consultancy has forecast.Reactions Of Companies Large tech companies are unhappy with such restrictive laws. Google’s privacy chief Keith Enright said in a recent blog post: “Mechanisms allowing for cross-border data flows are critical to the modern economy. Countries should adopt an integrated framework of privacy regulations, avoiding overlapping or inconsistent rules whenever possible.” Indian Firms, Especially Startups, Are For It Their push is from a data security angle and to safeguard India’s homegrown ventures. Companies such as Paytm and Phonepe have strongly endorsed data localisation, with a blog post from the latter contending that this move would “allow for better regulatory oversight and plug businessjurisdiction related loopholes that some foreign companies have long exploited to evade paying fair taxes in India.”Issues Remain Companies want to store, process and analyse data from multiple geographies. Some companies and lawyers argue that restricting the free flow of data may be counterproductive. “Excluding all Indian payment data from transfers is onerous, expensive, and can potentially limit the functionality which is currently available,” says Arun Prabhu, partner, Cyril Amarchand Mangaldas. Now, A Trade Issue While the tussle over data localisation started off within India, intense lobbying by tech MNCs has meant that this issue has now snowballed into one relating to free trade. Dennis Shea, the US ambassador to the WTO, has called for the banning of data localisation, even as US Senators John Cornyn and Mark Warner have called for India to soften its stance on the subject, according to a Reuters report.Does Location Matter? Technology experts such as Prashant Pradhan, vice-president and CTO (Asia Pacific) of IBM, argues that the physical location of data is irrelevant. Your data can be accessed from a server in Bengaluru or Boston just as easily. In fact, having a mirror of your data in India may actually increase the cost of operation and compliance. What’s more important is the quality, rather than sheer quantity. While terms such as big data were in vogue previously, what companies may be more interested in now is the quality of data they can secure and store. “While the amount of data itself has grown, what isn’t well understood is who has access to this data and what they can do with it,” he says.Regulations Around The World The European Union's General Data Protection Regulation doesn't have a specific data regulation rule, only stressing that cross-border data movement can happen if the other country has stringent rules to secure information. Several other countries have operationalised had various shades of data localisation. Nigeria has, for example, required all subscriber and consumer data of tech and telecom firms and government data to be located locally, since 2013. Germany mandates that telecom and internet service providers store data locally, while Russia¡¦s rules mandate citizen data be stored within its borders. However, by far, the most comprehensive laws are in China, where regulation covers not just personal information, but what is termed ¡§critical information infrastructure¡¨ that encompasses all aspects of daily life. Legal experts also say that the broad terminology paves the way for overt government access to this data and to build a strong cyber sovereignty.
