  144. Karnataka: 100% water tariff hike ups production cost for heavy industriesKOLKATA: Karnataka government’s decision to hike water tariff for industrial use by 100 times has led to significant escalation in production costs for industries in the state, particularly heavy industries like, steel, power and manufacturing. Faced with jump in costs the Karnataka Iron & Steel Association (KISMA) as well as other affected manufacturers have appealed to the state government for an immediate rollback of the tariff revision. Following a May 28, 2018 order for water drawn from dams and reservoirs, the tariff has been revised from previously Rs 3,200/mcft to Rs 300,000/mcft across industries. For water drawn from natural sources it has been revised Rs 150,000/mcft across industries from Rs 1,800/mcft earlier. The state has a steel producing capacity of nearly 18 million tonnes per annum and significant power generation capacity. It is also home to nearly 52,545 companies that provide direct and indirect employment to an estimated population of 2.1 million. The impact of the order could, hence, lead to disruption in production as well as possible job losses, according to leading industry body.In a letter to the state chief minister on Friday, KISMA said the decision to revise royalty rates on water for industrial use has come as a "rude shock."In this connection, the affected manufacturers have decided to make a set of recommendations to the state government including a roll back of the water tariffs and considering varying criteria before any further revisions. For example, there needs to be different rates for different type of water as is the case elsewhere where treated water has different tariff compared to untreated water. Another suggestion is on competitive tariffs compared to other states to retain and attract industrial investment. For instance, in the recent order by KBJNL, prices have been hiked to as high as Rs 3,00,000/- per mcft from Rs 3,200 per mcft, which translates to 100 times (10,000%) increase in tariff. However, when compared to rates in Tamil Nadu or a drought-stricken state like Rajasthan, the rates are Rs 14,000-Rs 20,000 per mcft. They also said industry should be made a partner for the state’s water conservation, management and utilization, instead of being penalized. Given the criticality of water resources, industries have already taken steps like adopting advanced and environment friendly technologies and have adopted processes which consume re-cycled and re-used water to the maximum extent. The water drawn for industrial purposes are also used for drinking water in the township, villages situated around the plants and in the surrounding villages. They are also suggesting a differential tariff structure under which lower rates need to be charged to industries who have developed infrastructure for drawing water, its usage and management, than those industries which use government owned infrastructure for drawing the water.Last but not the least, these manufacturers feel tariffs need to reflect commitment of an industry. Accordingly, the state should set up a mechanism to decide the cost of water on a case by case basis after giving due regard to the investment made in the infrastructure (to draw water) by an individual industry, alongside keeping in mind the considerations of investment, jobs and other commitments to the state.
  145. No relief from Supreme Court to Unitech MD Sanjay ChandraThe Supreme Court on Friday refused to grant "custodial parole" to Unitech Managing Director Sanjay Chandra as he said he was finding it difficult to raise funds and comply with the court orders.Chandra told a bench of Chief Justice Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud that he was not seeking bail but custodial parole. He said within a few days he would complete one year in jail, having been arrested on August 9, 2017.The Bench ordered the disbursal of nearly Rs 102 crore to home buyers seeking refund of their money on a pro rata basis.Chandra and his brother Ajay were arrested in April last year after the investors, who did not get flats in the company's projects as promised, filed complaints of cheating against them. They were then granted bail for three months to enable them to raise funds. Their plea for extension of the three-month bail was rejected by the trial court which sent them to judicial custody. The Delhi High Court also refused to extend the interim bail that ended on August 10.The apex court slated the matter for further hearing on August 21.
