This will be independent of the probe being conducted by retired Supreme Court judge BN Srikrishna, said the people cited above.An ICICI Bank spokesperson confirmed the development. “An independent law firm has been appointed by the audit committee to assist it,” the spokesperson said. Local custodians such as Kotak, ICICI, HDFC, Edelweiss, India Infoline, Axis and others â€" representatives of which are meeting this week to discuss the issue â€" prefer excluding Mauritius from the list, three persons aware of the development told ET.“Sebi is pointing out at findings on black money by JPC (Joint parliamentary committee) and SIT (special investigation team) earlier to push through a list of highrisk jurisdictions and curbs on non-resident Indians (NRIs). But countries like Mauritius have now brought in new anti-money laundering rules and informationsharing arrangement...It’s evident the regulator is acting at the government’s instructions,” said a person who has attended several meetings with Sebi on the subject.

Tata cos to run as per wishes of majority shareholdersMUMBAI: The operating companies of Tata Group have to be run as per the wishes of majority shareholders, Tata Trusts, which has more than two-thirds stake of the holding company Tata Sons, the recent NCLT ruling said.When Ratan Tata was executive chairman of Tata Sons, he was also the chairman of Tata Trusts. Therefore, there were no apprehensions over rights of majority shareholders being compromised. But when the executive chairman’s post went into the hands of the person who does not belong to the Trusts, to protect the rights of the majority, the Articles of Association article were amended by Tata Sons under the leadership of Mistry, who was the chairman of Tata Sons.In December 2012, Ratan Tata said that in future with the chairman of the Tata Trusts and Tata Sons not likely to be the same individual, it would be desirable to enter into an agreement between the Trusts and the Tata Sons to clarify the involvement of Trusts in terms of strategic plans, annual plans and divestment of shareholdings.

Wockhardt plans to sell four hospitals outside MumbaiMUMBAI: After selling the major hospital chains to Fortis nine years ago, the Habil Khorakiwala-promoted Wockhardt Hospitals plans to sell four of its seven residual hospitals located outside Mumbai.The group plans to sell properties in Nagpur, Nashik and Rajkot, according to two people aware of the development. Wockhardt has hired a Chennai-based investment bank to find a buyer for the assets.“Wockhardt plans to keep the Mumbai assets with them and offload the other hospitals,” said one of the sources cited above. The process is in very early stages and those hospitals in tier-2 cities may fetch a price of Rs 50-60 lakh per bed, he added. Currently, Wockhardt Hospitals have a strength of more than 1,000 beds under seven hospitals.Currently, it owns three hospitals in Mumbai â€" 350-bed tertiary care facility in Mumbai Central, South Mumbai, 350-bedded multi speciality hospital in Mira Road, North Mumbai and 45-bedded hospital in Vashi, Navi Mumbai.Founded in 2006, NM Virani Wockhardt Hospital in Rajkot is a super speciality hospital with 170 patient beds. In Nagpur, it has two hospitals â€" 118-beds super speciality hospital and a 50-bed heart hospital.Wockhardt Super Speciality Hospital in Nashik has 200 beds.In 2016, Wockhardt had closed down its 160-bed hospital in Cuncolim, Goa. It had shut down operations of five year-old hospital in Bhavnagar in 2013.When contacted, Zahabiya Khorakiwala, managing director at Wockhardt Hospitals, said the information is untrue. The 35-year old Zahabiya, daughter of Wockhardt chairman Habil Khorakiwala, joined Wockhardt Hospital in 2010 as executive director and was elevated as MD later in the year.The hospitals are not part of the listed Wockhardt Pharma.In 2009, Fortis Healthcare had acquired 10 Wockhardt hospitals in Mumbai, Bengaluru and Kolkata for `909 crore. At present, debt-ridden Fortis Group is in the process of selling ownership of 30 hospital chains to Malaysia's healthcare leader IHH Healthcare Berhad in a $1.1 billion deal.The healthcare delivery system in India remains under-penetrated and the potential for investments is quite high. This sector will require an investment of around $245 billion over the next 20 years, according to a recent PwC report. India needs to add 3.6 million beds, 3 million doctors and 6 million nurses over the next 20 years.However, the recent regulatory changes has brought down investors' interest in the sector.“The hospital industry is going through a downturn due to the price correction and increasing operating cost. Several hospital chains are up for sale in India, but a few can find buyers,” said a Mumbai-based investment banker.The price fixing under Modicare schemes will also affect the profitability of the private hospitals, causing exits by more players from the industry, he added.Last year, prices of cardiac stents and knee-caps had been regulated by the health ministry.In August, drug pricing regulator National Pharmaceutical Pricing Authority (NPPA) capped the prices of knee implants, reducing product prices by as much as 60-70%.Cardiac stents were also brought under price control and the price of drug eluting stents were slashed to about Rs 30,000 from Rs 2 lakh.IDFC Alternatives, the asset management arm of Infrastructure Development Finance (IDFC), could not find a buyer for its majority stake in Sahyadri Hospitals (SHL), the largest chain of multi-speciality hospitals in Maharashtra as the sale process was launched in 2016.However, large hospital groups keep strengthening their presence in the new markets through smaller acquisitions.India's largest hospital chain Apollo Hospitals had acquired a 50% stake in Lucknow-based Medics International Lifesciences for Rs 90 crore two weeks ago. Apollo made its last acquisition three years ago when it acquired Guwahati-based Assam Hospital (AHL) in 2015 as part of strengthening its position in the north-east region.

Railway board goes back on decentralisationNEW DELHI: The Railway Board has reversed its order delegating power to divisional railway managers (DRMs), rolling back a key reform that had been implemented last year. DRMs are additional secretary or senior joint secretary rank officials and operational heads of the railways across all its 68 divisions.The earlier order of delegation of powers to DRMs was issued to end the archaic departmentalisation that prevailed at the national transporter, which has a total of eight cadres of group A services.The high number of services and departments in railways has been holding up operational efficiency at the ground level by delaying the decision-making process, several expert committee reports have said in the past.To ensure that the railways worked as one department and not in silos, it was decided by the ministry last year that the authority for routine decisions at the division level including the transfer, interchanging and assigning of duties should rest with DRMs and not heads of departments. The order implementing the decentralisation was issued in November last year by the Railway Board.It aimed to promote better interdepartmental functioning and was the first of the many powers that were to be delegated to DRMs. DRM rank officials had very limited administrative and financial authority and the government had planned to gradually devolve this authority to them for efficient planning, faster implementation of projects and award of tenders.“The hands of DRMs have been tied again, as to change duties of a junior scale employee or to get more people on a particular project, they will be dependent on the head of the department,” a former DRM level official told ET.A fresh order issued on July 9 with the approval of Railway Board chairman Ashwani Lohani said: “The issue has been reconsidered and it has been decided by the Rail Board to withdraw the instructions. Decision taken, if any, should be withdrawn with immediate effect.”The chairman of the seven-member Railway Board had previously said that he wanted to give more powers to field officials. A press release issued by the ministry last year had counted empowerment of DRMs as a major reform.The Bibek Debroy committee had said that the overly centralised structure and departmentalisation was adversely affecting the railways’ work culture and leading to actions and decisions based on narrow departmental goals.“It is noted that many a time practices and incidents impinging on safety in train operation and also the cause of accidents are not fairly brought to the notice of management as departmental loyalties often overshadow the quest for getting into the ground realities for improvement,” the Anil Kakodkar committee had said in its 2012 report.

In the last six months when the Sensex gained 4.8 per cent â€" making it the best performing emerging market index in this period, many mutual fund schemes underperformed as the record-breaking rally has been driven by a few blue-chip stocks. Mid- and small-cap shares, the key drivers of mutual fund portfolio values of the last four years, are languishing, accentuating their underperformance.The large-cap fund category average returns in the last six months were 0.97 per cent, according to data from Value Research. Funds in the multi-cap category that invest in a mix of large-, mid- and small-cap stocks are down 5.18 per cent on an average. The mid-cap fund category has been punished the most, with schemes giving up 11.4 per cent in the same period.Five stocks â€" TCS, Infosys, HDFC Bank, Kotak Mahindra Bank and Reliance Industries â€" have accounted for 66 per cent of the 50-share Nifty’s rally from 10,000 to 11,000 in 2018. Last week, the Sensex touched an all-time high of 36,699.5, while the Nifty is just a little over 1 per cent from its lifetime high of 11,171.5 which it hit on January 29.

It’s a steep climb for Infosys to keep in step with TCSBENGALURU | MUMBAI: Tata Consultancy Services’ (TCS) has set an uphill task for its smaller rival Infosys to play catch up in an environment where there is a revival of large outsourcing deals from the banking and financial services industry, the biggest contributor to Indian companies and the US, its main market.Infosys saw business from banking clients dip 0.2% over the previous quarter compared to TCS, which saw 3.7% growth in the business during the same period.TCS is seeing revenue flow from the nearly $7 billion deals it signed over the last few months reflect in the quarter.“In general, the BFSI segment is slowing down investments in traditional outsourcing work, but increasing aggressively in emerging areas such as automation and digital,” said Phil Fersht, CEO, HfS Research. “Hence this is more of an indication that TCS is currently winning the larger piece of the emerging tech areas and Infosys is playing catch-up”.
