New Bill gives govt exception on your dataMUMBAI: The government may be exempted from certain rules applicable to the collection and storage of personal and sensitive data if such processing is required for the functioning of the government or Parliament, as per the draft Personal Data Protection Bill.The Srikrishna Committee on data privacy recommended exemptions also if such processing of data is important to the benefit of a person or required during any breakdown of public order.The draft bill mandated that processing of personal data cannot be done without informed and clear consent. This consent can be withdrawn by the person whose data it is. And any company processing personal data would have to establish that consent was given by the person. The bill, however, states that personal and sensitive data may be processed by the State if such processing is necessary for any function of Parliament or any State Legislature, for the exercise of any function of a State authorised by law for the provision of any service or benefit to the person from the State, or for issuance of any certification, license or permit.It also states that personal and sensitive data can be processed to respond to any medical emergency involving a threat to life or health, and to undertake any measure to provide medical treatment or health services to any individual during an epidemic, outbreak of disease, or any other threat to public health.Data can also be processed to undertake any measure to ensure safety of, or provide assistance or services to, any individual during any disaster or any breakdown of public order. The bill has expanded the definition of sensitive personal data to 13 types, compared with only five earlier. These include passwords, data relating to finances, health, sexual orientation, sex life, biometrics, genetics, transgender status, intersex status, caste or tribe, religious or political beliefs.The draft bill defines the processing of data as collection, recording, organisation, structuring, storage, adaptation, alteration, retrieval, use, alignment or combination by transmission, dissemination or otherwise making available, restriction, erasure or destruction.

The Tata group made an offer worth Rs 17,000 crore while JSW Steel offered Rs 11,000 crore on February 12, the last day for submission of bids. Liberty House which made its bid 12 days after the deadline offered Rs 18,500 crore.“The resolution professional (RP) has received revised offer from JSW Steel. There was heated discussion on this at a three hour meeting among lenders today. Finally it decided to invite revised financial bid from all applicants by Tuesday,” one of the officials quoted above said. “Lenders decided to go for a second round of bidding on the grounds that they have not yet voted for the higher bidder, so there is a scope to call for fresh bids,” he added. JSW Steel told ET that it did not want to comment on the matter.Last month, committee of creditors disqualified Liberty House after it failed to provide critical information on funding arrangement despite repeated reminders. The Tata group thus emerged as preferred bidder while JSW’s bid was not considered since it was too low. The new, revised JSW offer comes when Tata Steel had moved the courts questioning Liberty’s late offer. The bankruptcy court ruled in Liberty’s favour saying that that lenders should consider the bid despite the late submission.A recent spat between the consortium led by Dalmia Bharat and UltraTech Cement for Binani Cements shows that lenders have considered revised offers after the deadline in the past. After losing out to Dalmia Bharat, UltraTech Cement improved its offer substantially and moved the bankruptcy court when lenders declined to accept it. The court decided in UltraTech’s favour and its bid was later approved by all lenders when rival Dalmia declined to up its price.Bhushan Power & Steel is among the 12 large defaulters that RBI had directed banks to refer to the bankruptcy court. It faces claims of Rs 49,264 crore from financial creditors.

This is likely to increase compliance costs for technology giants such as Facebook, Google and Amazon. Clause 38 of the draft bill says any one collecting data could be termed a 'significant data fiduciary' based on the volume of data processed, the sensitivity of the data processed and its turnover.Factors such as the risk of harm in processing the data and the use of new technologies for processing data could also result in 'significant data fiduciary' classification.Acompany classified as a significant data fiduciary would need to register with the new Data Protection Authority and undergo data protection impact assessments, data audits, keep records and create a data protection officer role. The bill also states that the authority could require any data fiduciary to follow the rules, even if not classified as a significant data fiduciary, if there is a risk that a person could be harmed through the processing of their data.“Although audits and record keeping are seen as compliance costs, documentation keeping is really important in making sure privacy is not violated. It is about making companies accountable.Companies sometimes operating at scale may not know how the data is stored and shared,” said Public Policy Advisor at Mozilla Corp.Annually, companies will have to undergo data audits where the auditor will check if the company is in compliance with the provisions of the Act. A data auditor may assign a rating in the form of a data trust score to the company.
