Pepsi on war with FB, Twitter over Kurkure On Friday, July 20, Twitter user Nikhil Jois received a mail from Twitter notifying that his account information is being submitted to the court for legal process because of his tweet from June 2015 : âAlso⦠did you try burning Kurkure? It has plaâ from his handle @nikhiljoisr. Like Jois, hundreds of social media users in India are being notified that their account details is being submitted to the Delhi High Court over an ongoing civil suit in which PepsiCo is suing platforms like Facebook, Twitter, Youtube and Instagram. On June 1, PepsiCo India sued multiple American technology platforms claiming Rs 2.1 crore in damages for permitting the circulation of âdefamatory and disparagingâ content against its Kurkure brand. PepsiCo in its suit claimed that videos/posts on social media made false claims that the snack contained inflammable plastic and was unsafe for human consumption. âFrom what I understand, Pepsi has an issue with people talking about something that they have attempted to disprove multiple times,â said Jois, one of the users who was notified of the submission of account details to the court.âMy tweet didn't even say plastic, it just says âplaâ. Many of us joke about kurkure and plastic. To me it looks like a frivolous attempt at bringing up something the from the past.â Jois is currently not seeking any legal help in this matter. The consumer brand submitted that despite having prior knowledge of the false contents, the social media companiesâ refusal to take down the video/post without a court order caused negative engagement on social media, resulting in loss of reputation and goodwill.On Monday, the court directed the social media platforms to submit the account details of individuals who had posted/shared disparaging content about Kurkure in a âsealed envelopeâ to the court. Though it is not clear what 'account details' will be shared, it could encompass the archive of posts, handle, phone number, age, email address and the like of the user. The defendants have four weeks to remove all flagged content and provide the account details. The next hearing is on November 14, 2018.YouTube has said that it has disabled all the identified URLs, while Facebook and Twitter have not confirmed the content has been taken down.PepsiCo submitted a detailed list of all the links hosting the impugned content to the court. On Facebook alone, it submitted 3,412 links and 20,244 posts, while Twitter, Youtube and Instagram had 562, 242 and 6 links, respectively.Another Twitter user Srishti, received a similar email from Twitter about a tweet from 2015 when she had joked about Kurkure being used for plastic surgery. âIt was a harmless joke,â Srishti said. Upon hearing the matter on June 1, the Delhi High Court ordered the companies to block URLs, weblinks, comments and other contents that were disparaging to Kurkure. PepsiCo said that by not removing the video/posts the social media platforms were complicit in the loss of reputation and goodwill, indirectly amounting to encouraging the offender to post such defamatory content on their websites.However, Section 79 of the IT Act is the safe harbour for intermediaries like Facebook and others that do not make platforms liable for any third-party information, data, or communication links made available. âFacebook and others have followed the law by asking for a court notice to take down content,â said Anirudh Rastogi, lawyer at TRA law, a technology law firm. But, under the exception of Section 79, âPepsiCo might argue that since (the defendants) had taken down similar content back in 2013, and that there were several complaints made later on, why did they (social media platforms) refuse to take down similar content asking for a court order.âIn asking for the court order, Facebook is relying on Shreya Singhal judgement in 2015 relating to restriction on online speech. which revokes the power of the intermediality to block or decide what is right and wrong.âFacebook and YouTube responded that they had abided by the law in seeking the court order. A YouTube spokesperson said: âAs per the Supreme Court's order passed in Shreya Singhal case for an intermediary the âactual knowledgeâ under Section 79(3) of the IT Act is only attributable through a court order and/or a notification by the appropriate Government or its agency and does not refer to knowledge acquired by way of a complaint by the third parties.ââThe immediate cause of action for filing the present suit arouse in the month of May 2018 when the Defendants refused to remove/block the video despite plaintiff's (PersiCo) complaints,â PepsiCo said in its suit.The issue first arose in October 2013, when PepsiCo came to know about videos in which Kurkure was being burnt along with claims that it contained plastic. When this was reported by Pepsico, on October 10, 2013 Facebook removed the content.In the period between 2013 and 2017, Pepsico ran multiple campaigns to correct the claims. Recently, in 2018, when Pepsico again asked companies to take down the âdisparagingâ content, the defendants asked PepsiCo to obtain a court order to do so. 'As long as economic trajectory is intact, market should do well' Global asset allocators may get disturbed by a lot of political uncertainty and if they think the government is going to be unstable and there will be near-term volatility. But if India maintains the strong growth trajectory, market should perform well, Neelkanth Mishra, MD & India Economist & Strategist, Credit Suisse, tells Nikunj Dalmia of ET Now.Edited excerpts:There is definitely going to be an election uncertainty in the market. However, Sarkari (government) capex is likely to stay strong and the focus is again on aam aadmi yojanas (schemes for common people) in the runup to the election. How would you connect the dots here from a market standpoint? One is the market related thing and the second is the economic issues. There is hard economic reality and then there are the market perceptions. There are also viewpoints of people who allocate money. These people look at 25-30 countries and global issues and then take a 10-year bet on some place. From a pure economic perspective, the 25 years CAGR of growth in India is almost 7%. The five years CAGR is 7%, 10 year CAGR is 7%, the 20 years CAGR is 7% as well so we are effectively a 7% growth economy. If you put in 4%-5% inflation, 11-12% over 10 years is like tripling. So, the underlying growth trajectory in India is very strong.There are some headwinds which could become concerns but for now, the spurt in cheap data, the significant improvement in electrification, the rural networks are things that are driving remarkable changes in the overall economy and which is why you see 7% growth. Investors are aware of that. If growth decelerates from 7.8% to say 6.8%, people become uncomfortable. Then 6.8% become 7.5% and then things start looking better. So, people may trade around that but the structural view on the economy has to be that we will be growing at about 7% a year for quite a while and our investment behaviour has to be in sync so that steel demand will grow at 5%-6%, cement demand will grow at 4-5% and that is the underlying economic reality.There will be distortions introduced. There will be state governments giving farm loan waivers, like in Telangana, where Rs 4,000 was distributed on per acre of land. It is a bold experiment for a very tough problem. You will see all kinds of MSP increases.People will throw a lot at it because there is a lot at stake but in terms of the actual economic impact, we should not get distracted. They are very small numbers. The aggregate loan waiver in a full year would add up to about Rs 50,000-60,000 crore. We should not get distracted by that. When it comes to asset allocators, they may get disturbed by a lot of political uncertainty and if they think the government is going to be unstable. Some of the people, who are less familiar with India may get disturbed and there could be near-term volatility. But as long as the economic trajectory is intact, the market should keep doing well. What are your thoughts on financials? You like corporate banks but apart from corporate banks lot of new sectors have got created within financials -- small banks, micro finance companies that have become banks now; there are AMCs which have gone public. There are wealth management companies like IIFL Holdings which have become large in size. Apart from corporate banks, how else can one bet on the financial sector growth? Why the Caribbean is the best place for corporate fugitives to go incognito Fugitive Indian diamond merchant Mehul Chokshi, a co-accused in the $2-billion Punjab National Bank fraud case along with his nephew Nirav Modi, had obtained an Antiguan citizenship in November last year before the scam broke out. Choksi is not alone in running away to Antigua and Barbuda. Data analysed by TOI reveals that 28 Indians have applied for the citizenship of the Caribbean nation since 2014. Seven of these were granted the hassle-free Antiguan nationality between January 1 and June 30, 2017 itself, upon investment of $2,00,000, according to the half-yearly report of Citizenship by Investment Unit (CIU), which comes under Antiguaâs ministry of finance and corporate governance and public private partnerships. Why are the Caribbean countries a safe refuge for corporate fugitives?Easy citizenship for the richAntigua and Barbuda allows dual citizenship to foreigners if they invest in the National Development Fund (NDF), purchase government-approved real estate, or invest in a pre-approved business. To get an Antigua and Barbuda passport, Choksi would just have had to pay a minimum of $200,000 (Rs 1.3 crore) as a contribution to the Antigua NDF, or make an investment of $400,000 (Rs 2.7 crore) in a real estate project in Antigua, or an investment of $ 1,500,000 (Rs 10.3 crore) in a business there.Indians constitute 2.5% of citizenships out of total 1,121 foreign nationals who have sought refuge in the island since inception of this programme. The list is dominated by China â" with total 478 Chinese nationals (42.64%) applying for Caribbean nationâs citizenship since 2014.The fugitives or runaway businessmen flush with money made through scams can easily afford to buy citizenship in the Caribbean countries. Other Caribbean countriesAnyone with enough cash can also buy a passport for St Kitts and Nevis and have it within four months. All they have to do is to make a $150,000 (Rs 1.03 crore) contribution to the St. Kitts Sustainable Growth Fund or a $200,000 (Rs 1.3 crore) investment in a government real estate project. Once they have that passport there are 141 countries you can enter visa-free, including the UK and India. Those looking for a low-cost option can consider Dominica where an applicant can get irrevocable second citizenship and passport, with no visit to the country or even physical residency required, for just $100,000. All they have to do is to make a $100,000 (Rs 68 lakh) contribution to the Dominica Government Fund or spend $200,000 (Rs 1.3 crore) on real estate there. St. Lucia and Grenada too has similar laws on citizenship.Perks that come with the citizenshipThe citizenship is not just easy to get but also comes with some highly valued perks. With his Antiguan passport, Choksi can enjoy visa-free travel to approximately 132 countries, including the UK and all the countries of the Schengen area. He does not even need to live in Antigua and only needs to spend five days there in five years to retain his citizenship. Most Caribbean countries allow dual citizenship which keeps the door back home open for businesspersons being tried for crimes. Those who fear international sanctions against their own countries can save their business interests buying Caribbean citizenship. Super ease of doing businessThe Caribbean countries offer not just citizenship for money, they also promise a an easy and lax environment to conduct business. For example, most of these countries impose no direct income tax. Many also don't inheritance, capital gains and dividend income.
