Locally built engines propel 'Make in India'Defence Minister Nirmala Sitharaman today formally handed over two types of indigenously built high-power multi-fuel engines to the Army.The engines manufactured by the Engine Factory, Avadi -- a unit of Ordnance Factory Board, Department of Defence Production -- were fully indigenised for the first time under the Centre's Make in India programme.At a function held at the factory, Sitharaman formally handed over the documents of the two types of engines to Vice Chief of Army Staff Devaraj Anbu.The first engine of 1000 HP engine -- V92S2 engine -- powers T-90 Bhisma Tank, the second engine -- V-46-6 engine -- powers the T-72 Ajeya Tank and its variants.Though these engines were manufactured based on Russian design, India was depending on Moscow for its supply of critical assemblies like turbocharger, supercharger, fuel injection pumps.The Engine Factory under the Make in India programme manufactured the two engines with 100 per cent local parts.Earlier localisation level was about 73 per cent, officials said.The indigenisation efforts by the Engine Factory would save Rs 80 crore of the exchequer every year.It also exhibits the self-reliance of the Ordnance Factory Board in manufacturing these engines in India without any import support, the officials added.The Engine Factory has manufactured more than 12,000 engines since its inception in 1987.

Court rejects I-T department’s claims over VNR Infra assets under liquidationIn a landmark judgement, the Hyderabad High Court has refused to accept the claims of Income Tax department over assets under liquidation under the Insolvency and Bankruptcy Code, while advising the department to submit claims before the National Company Law Tribunal appointed liquidator.The Court, while hearing petition by a company that bought assets under liquidation challenging the attachment orders of the tax department, said the department cannot claim priority merely because its attachment orders were issued prior to initiation of liquidation proceedings.The Court was hearing the petition filed by Leo Edibles & Fats, which had acquired certain assets of VNR Infrastructures under liquidation proceedings initiated by the Tribunal appointed liquidator TSN Raja.The High Court bench comprising Justice Sanjay Kumar and Justice T Amarnath Goud has on Thursday directed the Registrar to register the assets purchased by Leo Edibles as advised by the liquidator.The Court has also directed the I-T department to submit its claims before the liquidator, who will consider them in terms of priorities stipulated under the provisions of the Insolvency and Bankruptcy Code (IBC) when distribution of assets was taken up.Earlier in January, Leo Edibles had emerged the highest bidder for the commercial/ residential building asset of VNR Infra located in Banjara Hills of Hyderabad at Rs 11.55 crore in an auction called for by the liquidator. Despite making necessary payments, Leo Edibles could not get the asset registered on its name with the Registrar refusing to do so, citing the attachment orders of the tax department that declined to lift the attachment.The Income Tax department has argued before the High Court that Section 33 of the IBC, which results in a moratorium on initiation and continuation of legal proceedings against the corporate debtor, wouldn’t be applicable in this case since tax proceedings were initiated prior to liquidation proceedings.The liquidator has argued that the dues of Income Tax department should be considered government’s dues and Section 53 of IBC made it clear that dues of government would be at the fifth position in terms of priority of repayments in the liquidation of assets of a corporate debtor. Further, Section 52 of IBC says no legal proceedings against the corporate debtor should be initiated without prior approval of the adjudicating authority â€" NCLT.Finding favour with the arguments of the liquidator, the High Court said “it is clear that the Income Tax department does not enjoy the status of a secured creditor, on par with a secured creditor covered by a mortgage or other security interest, who can avail the provisions of Section 52 of the Code.”Further, the Court said, “the Income Tax department not being a secured creditor, must necessarily take recourse to distribution of the liquidation assets as per Section 53 of the Code.”

Why the Caribbean is the best place for corporate fugitives to go incognitoFugitive Indian diamond merchant Mehul Choksi, a co-accused in the $2-billion Punjab National Bank fraud case along with his nephew Nirav Modi, had obtained an Antiguan citizenship in November last year before the scam broke out. Choksi is not alone in running away to Antigua and Barbuda. Data analysed by TOI reveals that 28 Indians have applied for the citizenship of the Caribbean nation since 2014. Seven of these were granted the hassle-free Antiguan nationality between January 1 and June 30, 2017 itself, upon investment of $2,00,000, according to the half-yearly report of Citizenship by Investment Unit (CIU), which comes under Antigua’s ministry of finance and corporate governance and public private partnerships. Why are the Caribbean countries a safe refuge for corporate fugitives?Easy citizenship for the richAntigua and Barbuda allows dual citizenship to foreigners if they invest in the National Development Fund (NDF), purchase government-approved real estate, or invest in a pre-approved business. To get an Antigua and Barbuda passport, Choksi would just have had to pay a minimum of $200,000 (Rs 1.3 crore) as a contribution to the Antigua NDF, or make an investment of $400,000 (Rs 2.7 crore) in a real estate project in Antigua, or an investment of $ 1,500,000 (Rs 10.3 crore) in a business there.Indians constitute 2.5% of citizenships out of total 1,121 foreign nationals who have sought refuge in the island since inception of this programme. The list is dominated by China â€" with total 478 Chinese nationals (42.64%) applying for Caribbean nation’s citizenship since 2014.The fugitives or runaway businessmen flush with money made through scams can easily afford to buy citizenship in the Caribbean countries. Other Caribbean countriesAnyone with enough cash can also buy a passport for St Kitts and Nevis and have it within four months. All they have to do is to make a $150,000 (Rs 1.03 crore) contribution to the St. Kitts Sustainable Growth Fund or a $200,000 (Rs 1.3 crore) investment in a government real estate project. Once they have that passport there are 141 countries you can enter visa-free, including the UK and India. Those looking for a low-cost option can consider Dominica where an applicant can get irrevocable second citizenship and passport, with no visit to the country or even physical residency required, for just $100,000. All they have to do is to make a $100,000 (Rs 68 lakh) contribution to the Dominica Government Fund or spend $200,000 (Rs 1.3 crore) on real estate there. St. Lucia and Grenada too has similar laws on citizenship.Perks that come with the citizenshipThe citizenship is not just easy to get but also comes with some highly valued perks. With his Antiguan passport, Choksi can enjoy visa-free travel to approximately 132 countries, including the UK and all the countries of the Schengen area. He does not even need to live in Antigua and only needs to spend five days there in five years to retain his citizenship. Most Caribbean countries allow dual citizenship which keeps the door back home open for businesspersons being tried for crimes. Those who fear international sanctions against their own countries can save their business interests buying Caribbean citizenship. Super ease of doing businessThe Caribbean countries offer not just citizenship for money, they also promise a an easy and lax environment to conduct business. For example, most of these countries impose no direct income tax. Many also don't inheritance, capital gains and dividend income. A tax-free business environment also pulls in a lot of regular businesspersons who are not running away from the law in their own countries.
