  • MUMBAI: In an apparent response to the Johnson & Johnson faulty implant case, which will get support from patients and consumer groups, the government is set to introduce a legal provision under which a company manufacturing medical devices will have to offer compensation to patients in case of an adverse event. This would help plug an alarming hole in the rules, due to which the government was “helpless” in directing the MNC to compensate patients who had undergone faulty hip implant surgeries. The provision is expected to be notified soon as part of the Medical Device Rules, 2017, official sources told TOI. The development assumes significance as it would be the first such law which would provide teeth to the government to prosecute such companies in case of an adverse event or death. The expert committee headed by Dr Arun Agarwal, which was formed by Union ministry of health to study the issue of faulty hip implants, had also recommended including the provision relating to compensation. Under the proposal, compensation will be offered to patients in case the medical device malfunctions or is unsafe, not compliant with the manufacturing licence, or causes injury, the source added. The company will be liable to pay compensation or take care of the patient’s medical needs (covering medical tests or corrective surgery) or both, depending on the severity of the case. Drug Controller General of India S Eswara Reddy confirmed the provision is being finalised, and will be put up for public comments soon, after which the notification is expected to follow. The provision will not specify the value of compensation, as that would depend on the severity of the case. Since the government had “in principle” accepted the recommendations of the expert committee earlier, this provision is expected to be introduced soon. The government recently constituted a central committee under the chairmanship of Dr RK Arya, director sports injury centre, Safdarjung Hospital, to decide the quantum of compensation. The decision to bring in the notification was taken as it would cut down the time, and multiple stages and approvals required for bringing it through an act of Parliament. The compensation is only in case of an adverse event/death reported for already approved devices, and not those which are under clinical trials. The adverse event also has certain riders that it has not been reported earlier (by other patients) when the device was under clinical trial and is not part of the package insert (leaflet) of the device.
  • The government has hiked interest rates of various small savings schemes for the third quarter (October 1 to December 31) by up to 40 bps. These schemes include the Public Provident Fund (PPF), Sukanya Samriddhi Yojana (SSY), National Savings Certificate (NSC), and post office time deposits. This is a welcome relief for fixed income investors as rates have remained unchanged for the previous two quarters. Added to that, the government had reduced the interest rates on these schemes in January -March 2018, quarter.According to a circular issued by the Finance Ministry on September 19, the interest rates of various small saving schemes have been hiked by between 30 basis points and 40 basis points. (One percentage point is equivalent to 100 basis points.)The one year, two-year and three-year time deposit interest rates have been hiked by 30 basis points. Rates for other schemes such as the five-year time deposit, Sukanya Samriddhi Scheme and PPF have been increased by 40 basis points.
