- The Supreme Court on Thursday restored a landmark Delhi High Court judgement which had decriminalised homosexuality in a move that was immediately hailed by the minority LGBT community.A five-judge bench led by CJI Dipak Misra read down Section 377 of the Indian Penal Code, to exclude all kinds of adult consensual sexual behaviour. The law will still stand on the statute book to deal with unnatural sexual offences against minors and animals such as sodomy and bestiality.The dreaded section not only made any kind of homosexual behaviour but also other kinds of âunnaturalâ sex such as oral and anal sex etc a criminal offence.A.M. Khanwilkar, R.F. Nariman, D.Y. Chandrachud and Indu Malhotra, were the other benches on the bench. The judgement was unanimous.The bench, however, stopped short of striking down the law. It also refrained from making a positive declaration of the communityâs right to life and dignity which includes the right to make a choice of sexual preference.The Delhi High Court had in 2009 taken this view, but a bench of the top court had controversially undone the ruling saying changing mores were best left to Parliament to deal with.Section 377 makes even consensual sexual acts -- both homosexual and heterosexual â" a crime if they are against the order of nature.Those in favour of diluting the law to decriminalise all consensual sexual behaviour have argued that majoritarian morality must make way for constitutional morality which makes it mandatory for the state to provide equality to all.No one can be discriminated against only on the grounds of their sexual orientation and called for constitutional protection to even sexual minorities.Those against diluting Section 377, sundry religious outfits and individuals, have cited morality, religion and cultural ethos of India had urged the court to retain the law on the statute book.The government on its part left the issue to the court, but insisted it cannot go beyond debating criminality, to examine other civil rights for the community such as the right to marry, adopt etc.Several leading lights of the small but significant LGBT community had challenged the very existence of the law on the statute book. A review of the top courtâs 2013 judgement is still pending.
- MUMBAI: Lahari Recording Company, a South India-based music label that has a tie-up with one of the largest music companies in the country, has filed a writ petition challenging certain Copyright Act provisions that deal with balancing what many would regard as the monopolistic powers of the music label industry.The Lahari petition challenges the constitutional validity of Section 31 (1) B and 31 D of the Copyright Act 1957, as amended in the year 2012, sources said.The relevant provisions of non-voluntary licences under the Copyright Act essentially attempt to balance the powers of music labels by allowing users, such as radio, TV, and Internet, to have continuity of business and also meet public interest by making copyrighted works available to all.These provisions are particularly important, according to industry sources, as music labels put out aggressive terms, including refusal of licences. In the past, various courts and governments have upheld the need for non-voluntary options under the Copyright Act.Sources said that this time, however, the government may not have an opportunity to put forth its views on the relevant provisions of the Copyright Act, and that the government has not even been served with a copy of the notice.According to an order of the Supreme Court registrar dated August 31, there was an attempt to serve the copy of the proceedings on the government.The DIPP, a commerce ministry body, oversees matters related to intellectual property. The order of the registrar notes that such service had been refused by the government, meaning that the government, perhaps, did not wish to be represented in this matter.The subject will now be listed before the concerned bench of the Supreme Court, as per the Registrarâs order.Section 31D of the Copyright Act was introduced by Parliament to empower broadcasters that have suffered, not knowing whether they would have any continuity of business. Sources say that it is imperative that the government is represented.
- NEW DELHI: Chinese Internet giant Alibaba groupâs UCWeb Wednesday said that it fully complies with the Indian laws and has already set up localised data centres across multiple cities in the country besides servers in the US as per industry practice.âUCWeb has been complying with local laws and regulations and in future too, it will continue to do so,â Shunyan Zhu, President, UCWeb at Alibaba Digital Media & Entertainment Group told ET, adding that data privacy and security remains companyâs top priority.âMost of the data stays in India and we have already set up servers in multiple cities in the country, in addition to servers in the US which is in line with the industry practice,â companyâs top executive said.In July this year, the Justice BN Srikrishna committee proposed Indiaâs Personal Data Protection Bill, 2018 to the Centre, with an aim to create a comprehensive framework for data protectionâ" suggesting companies to adopt certain practices to collect, process and store consumersâ data.Guangzhou-based mobile Internet company offers products and services such as mobile browser, Internet search, and news content in India, and its flagship UC Browser, topped the China, Indonesia and India market in 2013, according to a market research firm. The Chinese behemoth believes that the Prime Minister Narendra Modi governmentâs ambitious Digital India initiative provides massive opportunity, and alongside its benefits, the company is promoting it in a big way to bring an end to existing digital divide.The Centre is banking high on ambitious Digital India umbrella program to bridge the countryâs digital divide and aims to bring an array of citizen-centric services to be delivered electronically.âWe can see a quantum growth in mobile phones and improvements in data speeds and with mobile tariff coming down, the data usage in the country would continue to grow,â Zhu said, adding that the Alibabaâs Internet arm is facilitating the early adopters of Internet to have an access to information.The company, according to the executive, plays a key role in enhancing digital literacy, and UC browser, he said, is also available in nearly 10 local languages in addition to Hindi.The government, however, sees unavailability of local language content as a barrier to Internet penetration and Digital India campaign despite affordable data tariff being offered by incumbent service providers.Ministry of Electronics & IT (MeitY) secretary Ajay Prakash Sawhney recently said that various tools should be created in native languages as India has a unique position in terms of language diversity, which is considered as a barrier.The executive, however, did not specifically disclosed the amount of investment it is planning to make in India but said that it would continue to invest in the country to meet consumers requirements.
