  • By Debjit Chakraborty, Dhwani Pandya and Javier BlasIndia is not planning to buy any crude oil from Iran in November, raising the prospect that Tehran will lose another major customer as U.S. sanctions hit.Indian Oil Corp. and Bharat Petroleum Corp. haven’t asked for any Iranian cargoes for loading in November, according to officials at the companies. Nayara Energy also doesn’t plan any purchases, said an industry executive. Mangalore Refinery and Petrochemicals Ltd. hasn’t made any nominations for that month, but may do so later, a company official said.Final decisions on purchases aren’t due until early October, so the refiners could still change their minds. The company officials and industry executive asked not to be named citing internal policies.India is the second-largest buyer of Iranian oil, having imported an average of 577,000 barrels a day this year, or about 27 percent of the Middle Eastern country’s exports, according to Bloomberg tanker tracking data. With South Korea, Japan and European nations also cutting imports to zero, the loss of the Indian refiners, even if temporarily, is a major blow for the Islamic republic.At the same time, the U.S. sanctions that are due to go into effect in early November are creating a major gap in the global oil market just as Brent crude hits a four-year high above $80 a barrel. Mercuria Energy Group Ltd. and Trafigura Group, among the world’s biggest trading houses, are predicting the loss of Iran’s supply will boost prices to $100 a barrel for the first time since 2014.That risk has been echoed by some of the world’s biggest oil companies. BP Plc Chief Executive Officer Bob Dudley sees the sanctions on the OPEC nation having a bigger impact on the market this time than the previous round of restrictions six years ago.Harder StanceU.S. President Donald Trump’s administration is taking a harder stance. It wants all oil imports from Iran to end by November, and it’s unclear if any waivers will be granted. In previous sanctions under Barack Obama, the government had allowed nations to continue purchases at reduced levels.The tougher attitude is already showing in Iranian barrels vanishing from the market. South Korea became the first of Iran’s top-three oil customers to heed the U.S. diktat by refraining from any purchases last month. Japanese refiners have also temporarily halted loadings.India and China had held out hope for Iran. It was only about four months ago that India’s foreign minister said that the country won’t adhere to unilateral restrictions and will continue buying Iranian crude. China also made similar comments and was said to have rejected an American request to cut imports.When Trump in May announced plans to reimpose sanctions on Iran’s oil exports, the market estimated a cut of about 300,000 to 700,000 barrels a day, Trafigura’s co-head of oil trading Ben Luckock said this week. However, the consensus has now moved to as much as 1.5 million barrels as the U.S. is “incredibly serious” about its measures, he said.
  • Former RBI chief Raghuram Rajan has dissected the banking crisis in his recent analysis of non-performing assets (NPAs). He implies that cronyism is an important cause. I would say the anti-corruption activism of NGOs, the Comptroller and Auditor General (CAG) and courts â€" all aimed at reducing cronyism â€" has played a major role too.Rajan says one reason for NPAs was over-optimism after the initial success of public-private partnerships (PPPs) in infrastructure during 2006-08, leading to explosive expansion without due diligence. Second, slower GDP growth after 2008 meant that traffic and industrial demand were far less than projected. This was exacerbated by delays in land acquisition, and non-availability of gas and coal for power plants.Pros and ConspiraciesThird, promoters and banks conspiredto hide the rise of NPAs, evergreening loans. Fourth, malfeasance and inflated cost projection by promoters proliferated, to skim off the excess. Fifth, fraud and diversion of funds were unchecked by banks and RBI, which lacked the capacity to monitor projects and diversion. Thus, says Rajan, did bankers, promoters and circumstances create massive NPAs.Agreed. But there was much more. Pronab Sen argues (‘What Ails the Indian Banking Sector’, Mint, goo.gl/xX3zx7) that banks should not have been forced to get into project finance at all, let alone on a grand scale. They grew for decades through working capital and retail lending. They had no ability to judge project costs or risks. But they jumped in, often on political orders or pressures.Sen thinks that, ideally, the bond market should finance all or most infrastructure. This has advantages, but the bond market is far too small for this. Besides, bond buyers â€" mutual funds, pension funds, insurance companies â€" will be decimated if bond defaults are as common as bank NPAs, and the human and economic impact may be just as bad.Rajan says he sent a list of prominent bank fraud cases to the PMO, but heard nothing more about it. This has led to accusations that cronyism has been the root cause of record NPAs. That is simply wrong.Before 1991, in the licence-permit raj, every clearance, permit and licence was a favour. There was nothing but cronyism. Quasi-monopolies spread across the economy, since free competition was forbidden.Economic reform after 1991deregulated large parts of the economy, creating competition that destroyed old crony quasi-monopolies. In most areas, cronyism disappeared. But in some areas â€" minerals, energy, infrastructure and government contracts â€"clearances remained controlled by politicians, and outcomes depended on political discretion and bribes. After 1991, politicians gave up kickbacks in liberalised sectors, but more than made up from the remaining controlled sectors. Record sums were spent by politicians on elections. (Gopinath Munde confessed to spending .`8 crore in the 2009 elections.) Public anger against corruption skyrocketed after 2011, fuelling the Anna Hazare agitation. This was buttressed by CAG and Supreme Court activism. An outraged Supreme Court cancelled spectrum and coal-block allocations, decreeing fresh auctions. The court also closed several iron ore mines to curb illegal mining.Winning Bids, Losing BetsChecking corruption was surely necessary. Yet, let it be acknowledged that court activism massively expanded NPAs. Many steel and thermal power plants that lost their coal and iron ore mines went deep into the red. The telecom sector was savaged by the cancellation of spectrum licences, and by the resale of cancelled spectrum at very high prices. The ‘winner’s curse’ meant auctions were won at inflated prices by the most overt-optimistic bidders, creating potential NPAs even before the bids were opened.These problems were magnified by the ending of the old culture of the licence-permit raj, in which success flowed from grabbing any and every licence available, no matter how bad economic conditions were, and then manipulating politicians for policy changes to make bleeding projects profitable. Dhirubhai Ambani was the master of such manipulation. But others were not far behind. To avoid job and production losses, policy changes could sometimes be arranged even without bribes.That old culture continued till the 2000s. Out of Andhra came the ‘Andhrapreneurs’, contractors from the state’s irrigation works. These were new names at the national level: GVK, GMR, Lanco, IVRCL, Nagarjuna. They won enormous infrastructure contracts by bidding aggressively. But many ran into problems of land acquisition, non-availability of fuels and exaggerated demand forecasts.They expected that, as in the past, they would be rescued by policy and contract changes. But after the activism of Hazare, CAG and Supreme Court, such manipulation became impossible. The result was an explosive growth of NPAs.To be sure, there was also plain crookery in some failed projects, with promoters diverting funds after inflating project costs. But such crookery was common during the licence-permit raj too. The big difference after 2012 was that failed projects could not easily be revived by changing contract conditions.There is no silver bullet for NPAs. Banks must take haircuts and be recapitalised. Bust companies must be sold at a discount or liquidated under the Insolvency and Bankruptcy Code (IBC). Political discretion in allocations must be curbed. The auctioning of not only spectrum and coal, but all minerals, is now reducing cronyism. But the unfinished agenda remains large.
  • KOLKATA: The telecom regulator has called for speeding up the mobile number portability (MNP) process --- which allows customers to keep the same number anywhere in the country â€" by halving the processing time of porting requests within a circle down to two days.The processing time for porting requests from one circle to another has been retained at four days.In its draft amendment regulations, 2018, aimed at making MNP more efficient and hassle-free for mobile users, the Telecom Regulatory Authority of India (Trai) has also mandated two sets of financial disincentives for failures on the part of telcos in stick to porting request processing timelines.For instance, a telco, the regulator said, will have to shell out a peak penalty of “Rs 5,000 per contravention” for flouting rules requiring it to share customer details with the MNP service provider within 24 hours of a customer submitting a porting request besides texting the customer about the process being initiated. The penalty doubles to Rs 10,000 per violation for “wrongful rejection” of porting requests by a telco.The sector regulator said “porting code mismatch” and “invalid/expired codes” constituted nearly 45% of the grounds on which MNP porting requests were rejected by telcos between April 2017 and May 2018.Since “there is no improvement in (porting request) rejections in major categories, appropriate corrective measures are required to strengthen the MNP process,” the regulator said in the draft MNP rules issued Tuesday.Phone companies expressed dismay over Trai’s call to impose stiff penalties for non-compliance of the MNP drill.“Penalties are extremely blunt instruments to ensure MNP compliance, and rather a partnered approach with Trai to ensure our mutual goals are met and difficulties ironed out would be the preferred approach,” said Rajan Mathews, director general of the Cellular Operators Association of India (COAI), which represents Vodafone Idea, Bharti Airtel and Reliance Jio Infocomm.Demand for porting requests, he said, “have peaked after the closure of (fringe players) Aircel, Telenor India and Reliance Communications amid heavy demand from customers of these companies to move to other operators.Mathews stressed that telcos, on their part, are doing their best “to ensure customers are not inconvenienced during the MNP process and are working to put appropriate systems and infrastructure in place to comply”.Telcos have backed Trai’s call to make the MNP process more efficient but have repeatedly cautioned that the porting scenario in India with over a billion mobile users across 22 circles is a lot more complex than the rest of the world.A key corrective measure suggested by the regulator is making the MNP service provider responsible for generating porting codes to make the treatment of porting requests more impartial and curb rejections.The sector regulator said separate timelines had been kept for porting requests within a circle and from one circle to another at the suggestion of the telecom department (DoT) till the full-fledged implementation of the Central Monitoring System (CMS) networks surveillance system.India’s upcoming automated surveillance system or `CMS’ will have the capability of tracking all forms of communications â€" wireless, landline, satellite, internet to even voice over internet protocol calls.“It’s anticipated that by the time the MNP process is implemented, the CMS installed by DoT would be fully operational and all concerned security agencies would be using the centralised system,” Trai said in its draft MNP regulations.Timelines will not be advanced for porting requests of corporate mobile numbers under the revised MNP process, the regulator said.Back in April this year, Trai kicked off a process to overhaul MNP rules to remove inconveniences faced by subscribers under the current system. MNP was first introduced in India in 2011, but was restricted to within a circle. It was expanded to users moving to another circle in 2015.Earlier this year, the regulator had also slashed by nearly 80% to a maximum of Rs 4 the fee charged to consumers for porting from one service provider to another.Trai has sought stakeholder comments and counter-comments on its latest MNP draft amendment rules by October 24.
  • Chinese home appliances maker Haier and global investment firms Blackstone and Goldman Sachs are among the suitors considering making offers to buy bankrupt Videocon’s consumer electronics business valued at close to $2 billion, according to people directly briefed on the matter.All three prospective suitors have reached out to Videocon’s lenders either through their financial advisors or directly, according to people in the know.A formal auction process for sale of the electronics business, which is distributed between as many as fifteen legal entities of Videocon group, was formally launched on Tuesday.The investment firms may consider teaming up with local business houses prior to placing binding bids, sources said.At least one other Chinabased investment holding company was interested in the assets, according to people in the know, though the final tally of suitors would be known once expressions of interests are received in the first week of October.Spokespersons for Haier, Goldman Sachs and Blackstone declined to comment on the story when contacted by ET.
  • NEW DELHI: The government will cancel clean energy auctions if the tariffs discovered through competitive bidding are found unreasonable, minister for power and renewable energy RK Singh said, signalling a tough stand against any apparent malpractice in bidding.Responding to questions on a recent cancellation of bids received for 2,400-MW solar projects, Singh said his ministry is keeping a watch on global trends that influence clean energy tariffs and hence the ministry in its right can exercise its discretion to define the maximum permissible tariffs for solar bids.“I am here to protect the people’s interest. We will accept bids which are reasonable. If I come across any bids which are excessive, we will cancel it,” Singh said on Tuesday.Recently, the power minister wrote to the finance ministry alleging a cartelisation attempt by SoftBank-backed SB Energy to jack up tariffs in a 3,000-MW solar tender floated by the Solar Energy Corporation of India (SECI), which stood partly cancelled after the price bids were submitted by developers. SoftBank firmly denied the allegation and said it always abides by the law and acts ethically. Officials, however, said bids were rejected only because of high prices. “There is no allegation of any kind."We found certain bids to be unacceptable and we did not accept the bids, (on the ground that) the price was high,” Anand Kumar, secretary, Ministry of New and Renewable Energy, said while addressing a press conference ahead of its flagship renewable energy event RE-Invest and the first general assembly of International Solar Alliance next week.The government and the private sector have recently been at odds following the former’s decision to cap solar tariffs at Rs 2.5 per unit for solar auctions conducted by SECI, with a margin of 18 paise if safeguard duty is being factored in.
