Kunal Bothraâs top 3 bets for trading on Monday - The central bank pointed out that credit and debit cards are issued by banks globally and dual regulation over such instruments âwill not be desirable.âSince Indiaâs payment system is bank-dominated, oversight by the same regulator inspires public confidence, it said.âSettlement systems are finally posted in the books of account of banks with the RBI to attain settlement finality. Regulating these entities goes hand in hand with the settlement function,â it said in the dissent note.The central bank argued that since currency is the foundation, payment systems lie within the remit of the RBI.âPayment systems are actually technology based substitutes for currency. The distribution of currency is done by the RBI through the banks; the logical extension of this to payment systems has being yielding good results,â it said. âFintech companies and other non-banks have been bridging this function very well. It is not clear how non-banks can be ascribed the job of creating money via payment systems. It needs to be recalled that even banks distribute currency on behalf of the RBI and cannot create their own currency.â

The asset-liability mismatch refers to the imbalance between short-term borrowings and long-term investments.Bank credit growth has averaged 7% in the past two years, whereas overall credit expansion was more than 10%, aided by over 20% growth in NBFC credit. Banks have a lending exposure of Rs 5.9 lakh crore to NBFCs.LENDING OPPORTUNITYâTodayâs move by RBI will certainly ease liquidity for the NBFCs from the banking system. However, the impact will be felt more prominently by private banks that can now leverage this additional window of liquidity to lend to NBFCs,â said Sanjay Chamria, managing director of Magma Fincorp.RBI also said that banks can count higher lending to NBFCs equivalent to excess government bonds they own for meeting the liquidity coverage ratio (LCR) â" liquid assets needed to meet short-term liabilities. âThe single borrower exposure limit for NBFCs which do not finance infrastructure stands increased from 10% to 15% of capital funds, up to December 31, 2018,â RBI said in a statement.Chamria welcomed this move but said single client exposure limit may need to be phased back to 10% gradually in 2019. âRBI may need to clarify whether the higher single-client exposure up to 15% taken till December 31, 2018, could be extended thereafter,â he said.LIMITED BENEFITS?Only some NBFCs may benefit from the move, experts pointed out. âWhile this is an important signal of regulator's intention of ensuring market stability, the current measures may primarily benefit only select NBFCs like HDFC,ââ said Ashish Gupta, analyst at Credit Suisse. âThe LCR relaxation capped at 0.5% translates to a Rs 50,000 crore headroom for NBFC lending.âThe latest step is among a series of liquidity infusion measures by the RBI as short-term interest rates spiked despite the monetary policy committee keeping interest rates unchanged at its recent meeting. While shifting its stance to âcalibrated tighteningâ from âneutral,â it maintained the repo rate at 6.5%.While promising sufficient liquidity in the financial markets, the central bank was critical at the time of the asset-liability mismatch at NBFCs and suggested that they raise more equity and long-term funds rather than focusing on profitability with short-term funds that create instability.
- The Rungtas denied all the allegations and declined to comment beyond that in response to ETâs queries. âWhile denying all allegations, we would like to submit that the matter is pending before the honâble committee appointed by the honâble Supreme Court, wherein proceedings have been completed and the orders are reserved,â advocate Sandeep Das told ET on behalf of the Rungtas. âTherefore, we would not like to comment since the matter is sub judice.â Siddharth Rungta, a director at the four firms and past president of the Federation of Indian Mineral Industries, also refused to comment on a matter that was âsub judice.â He said the committee was investigating many cases.Common Cause, which is âdedicated to championing public causesâ and has been criticised by various political parties for its activism, often uses the public interest litigation (PIL) route to unearth corruption. Among the cases it has been involved in are those that led the Supreme Court to cancel telecom spectrum and coal block allocations and strike down Section 66A of the IT Act for curbing freedom of speech. Bhushan, whoâs on the governing council, is among its most high-profile members and lead lawyer on most of the cases. The NGOâs petition against illegal mining in Odishaâs iron ore and manganese sector had resulted in the Supreme Court imposing a fine of more than Rs 17,000 crore on mine owners in a landmark order in August 2017. The bench had set up a committee of retired Supreme Court judges to examine de novo (since the start) a number of specific cases. While doing so, the bench had clarified, âthe committee would be entitled to lift the corporate veil.âThe cases fall into two categories. The first relates to lessees accused of transferring control of their mines without the stateâs approval in violation of Rule 37 (now Rule 24) of the Mineral Concession Rules. (ET has reported previously on this accusation also faced by Aryan Mining and Trading Corp., DR Patnaik, KJS Ahluwalia and Sarda Mines among others.) In the second category are lessees accused of violating Section 6 of the MMDR Act, a provision that caps the grant for each mineral and the total area that can be granted to a person or company in a state, unless the Centre has made a special exemption as it has in Tata Steelâs case. The Rungta firms fall in this latter category.The committee finished hearing the matter in early July and is expected to submit its report in the next few weeks. The Rungta companies have strongly objected to the submissions by Common Cause, alleging they had been filed on July 10, 2018, three months after the committee had finished hearing them, âwith a view to reopen their cases.â Bhushanâs submission had claimed Nandlal Rungta, his brother Mukund Rungta, son Siddharth Rungta, and their respective wives are the only significant shareholders of all five firms (see table). âThe various mining leases in Odisha held by each of these companies are in reality for the benefit of one family,â Common Cause said. âThe Rungtas have sought to cheat the area restriction provided under Section 6 of the MMDR Act by holding these mining leases in the names of their companies.âSubsection 3 spelling out how the total area should be determined, requires âthe area held ...by a person as a member of a co-operative society, company or other corporation or a Hindu undivided family or a partner of a firm) to be deducted from maximum prescribed area... so that the sum total of the area held by such person (whether as a member or partner or individually) does not exceed the specified cap.â Bhushanâs petition said Nandlal Rungta and Mukund Rungta also exceed the 10sq km cap individually on a pro rata basis through their stakes in the companies and share in the family business. The Odisha government has maintained that no laws have been broken. It said the Supreme Courtâs Central Empowered Committee had given a clean chit to the companies and the state, which was found to have âmeticulously followed provisions while granting and renewing these leases.â Its affidavit also quotes the amicus curiaeâs reasoning to the Supreme Court that ânone of these persons (lessees) are members (shareholder/partners) in other personsâ lessees.âThe Rungta lawyers make the same argument--that each company is a separate legal entity registered under the Companies Act and distinct for the purpose of the MMDR. None of them have exceeded the cap, not even between 1958 and 1972, when the limit was 10 sq miles or 2,589.99 hectares, they claim. Their rejoinder argues that as far as the MMDR was concerned, a âpersonâ, whether as an entity or an individual member of a company or cooperative, must always necessarily mean a lessee or someone applying for a mining grant. According to them, subsection 3 aims to âinhibit crossholdingâ by one lessee as a member partner in another lessee. None of the five firms were shareholders in any of the other firms, and none of their shareholders (or individual Rungta family members) were lessees. Thatâs why the logic of aggregating proportionate leasehold areas of Nandlal Rungta and Mukund Rungta had no legal basis, they said. In any case, even by that âerroneous logicâ, they held (on March 31, 2017) a cumulative 825.61 hectares and 960.47 hectares, respectively, less than 10sq km each, according to the Rungta lawyers.The Supreme Courtâs August 2017 order recognising that âpersonâ was not defined in the MMDR Act, also pointed out that the law bars a person (or company) acquiring in the name of another person (or company) a lease intended for himself or herself. The Rungta firms strongly objected to the charge of âcheatingâ, pointing out that all five companies were incorporated or established decades before subsection 3 as introduced into the statute in 1972, according to them, because âlarge portions of leasehold area was being left unutilised then and not to prevent monopolisation of natural resources.â
- Unilever. Edited excerpts: We continue to see heightened volatility and on Friday we got very close to the 10,200 mark. Do you expect a breach of that?We may not breach those levels but for the expiry next week, the 10,200 support should hold on. There are a couple of reasons for that. One, we see a clear outperformance of Bank Nifty compared to Nifty not just for the week but relatively in the last two weeks as well. Bank Nifty had made a low of 24,250 approximately on spot. It is trading above 25,000 and so there is a cushion of 750-800 points for Bank Nifty whereas for Nifty that cushion is only 60-70 points. So relatively, Bank Nifty is still on a stronger footing and that is one of the core reasons why the benchmark Nifty has not given a breakdown and that support should hold on. In terms of sectors, there are lots of sectors which are showing signs of aggressive weakness but still there are stocks like Jubilant Food, HUL and most of these other stocks which are trying to make a good comeback. Net-net, next week you should see some stability coming back into the indices and the support of 10,200 should hold on to the index. Would you buy Bajaj Finance and Piramal Enterprises now and how much more of a pain do you sense in the pipeline? For Bajaj Finance, at current levels, there is enough strength visible on the charts and that strength itself could be decent enough for the stock to continue to outperform or even stay at current levels and not behave in a volatile fashion. Piramal Enterprise is at a very attractive level to consider buying this stock but the indicators on the timeframes, especially on the hourly charts, have not yet entered the extremely oversold territory. We would wait for a couple of days of bounce, then look out for credible supports getting built for Piramal Enterprise. Even if it is Rs 100 higher from current levels, that would not be a bad bet at those levels. But at current levels, I would watch Piramal Enterprise and wait for better levels to buy. Any interesting trades for Monday? Quite a few, really. I will list three of them. The first is a buy on Jubilant Food. The stock showed good resilience on Friday and managed to claw back above its 200 DMA. That is the first buy, targets of Rs 1320 and stop loss at Rs 1248. The second would be a buy on NIIT Tech. The midcap IT stock has shown four days of consecutive price upmove. It has bounced from its 200 DMA and the chart looks quite attractive on the short-term timeframe. NIIT Tech is a buy with targets of Rs 1295 and stop loss Rs 1220. The third stock is also a buy. Hindustan Unilever is more of a defensive play. The stock has been holding on to its 200 DMA and I believe Hindustan Unilever could see some potential upside from current levels. That is a buy with targets of Rs 1620 and stop loss Rs 1546. Do you believe that either a Maruti or an Eicher are now in the buy zone? Absolutely. Maruti, Eicher Motors and even Bajaj Auto. To a large extent, even Hero MotoCorp, maybe not at the current price but another Rs 100-150 lower and it would also enter into those technical value territories. Most of these stocks have corrected significantly, not just in terms of price but in terms of indicators and that too on the monthly charts which makes them more attractive for a longer term investor to try and invest maybe some portion of their investments into these names, categorically Maruti, Eicher Motors, Bajaj Auto and also Hero MotoCorp.
