This means that the public cannot access the names of entities who have donated more than Rs 2,000 to a political party, defeating the objective of the move initiated in 2017. The EC is also unable to do anything on the matter as rule books do not allow it.The EC had first pointed out this anomaly to the government in 2017.ET has learnt that the EC is now considering the matter afresh in light of the contribution reports filed, and will, in all likelihood, reiterate the need to amend the Representation of People’s Act so that the anonymous cash donation cap of Rs 2,000 is adhered to.Both, Mayawati’s BSP and Sharad Pawar-led NCP have not declared or referred to any contribution below Rs 20,000 in the latest 2017-18 contribution reports filed with the EC, sources told ET. The BSP has gone on to declare it has not received any contribution above Rs 20,000 in 2017-18, skipping all mention of the new Rs 2,000 limit. The Communist Party of India is the only party so far to have sou moto declared donors of all amounts down to Rs 1,000. The Congress, the BJP and Trinamool Congress are yet to file contribution reports. The three parties that have declared funds have also not mentioned any funding received via electoral bonds.

El-ErianHaving followed Gita Gopinath’s work closely for several years, I am delighted the International Monetary Fund appointed her to head its influential research department as chief economist.Gopinath, a professor of International Studies and Economics at Harvard University and co-director of the International Finance and Macroeconomics program at the National Bureau of Economic Research, brings expertise, insights and cognitive diversity to the IMF. Her appointment comes at an important time, as the fund seeks to evolve its thinking and practices to better reflect realities on the ground, particularly the two-way causal relationship between macroeconomic and financial issues.Trade, productivity, debt, capital flows and the functioning of exchange-rate systems are among the top puzzles and challenges facing the global economy as a whole. If the IMF were to survey its 189 member countries, these questions would also be among the top issues that national policy makers confront in formulating strategies for their countries.As I argued last week, these concerns reflect what.London Business School’s Hélène Rey and others have called ‘the global factor’: a set of external influences that countries cannot manage or control, but that play an important role in determining key domestic variables. This has generated economic and financial volatility that has complicated internal policy management, fueled political polarization, and exacerbated social divisions.These topics have also featured prominently in Gopinath’s research and publications, which have tended to challenge conventional wisdom and push the collective thinking forward in a beneficial way. Her work has been recognized with many impressive appointments and accolades, including co-editor of the American Economic Review, being named four years ago among the top 25 economists under the age of 45, and serving on several Federal Reserve advisory councils.For all these reasons, I have little doubt that Gopinath has the potential to bring dynamic new thinking to the Fund. Also, she joins a group of IMF directors that will benefit from greater diversity. She is the first woman appointed to head the research department, which produces the fund’s regular flagship publication, the World Economic Outlook, and is one of the most read documents released by multilateral institutions, not only because of its analyses of the developments and prospects for the global economy but also for the special topics that are addressed in depth.(Full disclosure: I served in several posts at the IMF, including deputy director, from 1983 to 1997, and have been on several of its advisory groups since then.)There is no question about the strong professional attributes that Gopinath will bring to the challenge of enhancing the work and impact of the IMF. It remains to be seen whether the fund will be able to incorporate her thinking in a range of areas, including better coverage of the linkages between finance, market technical volatility, and spillovers for the real economy; enhancing early warning analyses; increasing the resilience to market instability of individual country programs; and developing a wider toolkit for dealing with overshoots in capital flows, both feast and famine. This will require open-mindedness, intellectual agility and a willingness to revisit some longstanding conventional wisdom.With its quasi-universal membership, comprehensive mission statement, and talented staff, the IMF is the best of the global multilateral institutions that offer guidance on macroeconomic and financial issues.   • NEW DELHI: A year after the Modi government announced capping of anonymous cash donations to political parties at Rs 2,000, it has emerged that the aim of the move â€" to ensure greater transparency in funding â€" cannot be fully realised as the Centre failed to amend an electoral law that the Election Commission had asked for.While the government brought in an amendment to the Income Tax Act with Section 13A to say that political parties will have to declare all donations above Rs 2,000 to obtain tax exemption, it did not amend Section 29C of the Representation of People’s Act, 1951, to reflect the same, despite the EC flagging the issue to the law ministry twice last year.
  • KHERI: As per the Saubhagya scheme’s online dashboard, Kheri district of Uttar Pradesh would perhaps qualify as the ‘dark spot’ of India as it has the most number of un-electrified households in the country at 5.35 lakh.A missing electricity line to the primary school in Rehua village of Kheri, despite existence of electricity poles inside the school compound, however tells another story. “People of the village stole that line in the night some months ago to use it for drawing an illegal connection.The school has no electricity now and children have to study in the open,” the school’s teacher says, not wishing to be identified. In fact, many houses in this village have electricity, despite the Saubhagya dashboard saying 376 out of 469 households in Rehua are still to be electrified under Saubhagya.“Most people have illegal connections. Why to take a metered connection? We won’t be able to pay the bill,” village r Ram Naresh told ET. This reluctance to take a formal connection for fear of paying for power explains why not even a single connection has been released in Rehua under Saubhagya for a year, as per the dashboard.There is a 25 KVA transformer and about 500 meters of transmission lines here but not many takers for a connection.“A team of power officials did come few days ago but returned,” the teacher said.Transmission losses are very high in Kheri district and its record under ‘Saubhagya’ is woeful â€" releasing just 55,000 connections so far with just 10% progress towards the PM’s target of fullelectrification by December 31. In Devi Purva village, where the dashboard shows 1092 out of 1246 houses are un-electrified, villagers claim non-supply of meters is the issue. Only 35 connections have been released here so far but most houses seem to have power. “I got a metered connection and paid Rs 2,200 as bill for three months.   • Daniel Kotchen would not be a name familiar to India’s $1.5-billion software services industry if not for half a dozen lawsuits bedeviling the sector, including two against the country’s largest software exporter Tata Consultancy Services. The Washington DC-based lawyer and his firm, Kotchen & Low, filed its latest class action suit against TCS last month, accusing the Mumbai-based company of discriminating against US citizens when hiring in that country. Kotchen has, so far, filed a total of seven class action suits against the top six Indian IT services companies. The first against Infosys was filed in 2013, TCS was sued in 2015, and Wipro and Cognizant in 2017. Last month, lawsuits were also filed against HCL Technologies and Tech Mahindra. These cases are yet to be decided, with a hearing in the lawsuit against TCS due in November. If Kotchen wins, not only could he cost Indian outsourcing companies millions of dollars, but could also hurt their reputations at a time when they are battling the rising threat of protectionism in their largest market â€" the United States. Collectively, top Indian outsourcers employ over one million people globally, an overwhelming majority of whom are Indians. “Our practice in this area is devoted to protecting employees and their rights â€" whether they are visa holders or local hires,” Kotchen told ET in a telephone interview. His 10-year-old law firm has five lawyers listed on its website. Kotchen did not start out to lead a crusade against Indian IT companies. “Once we started working on the issue, our name got out there and folks started bringing us other cases,” said Kotchen, who received his law degree from the University of Wisconsin. The lawsuit against TCS will head to a jury trial in the first week of November. A group of Southern California Edison employees have been certified as a class. TCS lost its bid to get a court to restrict the case to just monetary damages. Kotchen said while companies try to get the cases thrown out of court, judges have used precedents from other discrimination cases filed against Indian IT companies to deny those requests. He said he would not be the right person to ask about a settlement. “That would be a question best asked to the company,” Kotchen said. TCS did not respond to a request seeking comment sent last Thursday. Representatives of Infosys, Wipro and Tech Mahindra dismissed allegations of discrimination and said they are equal opportunity employers. The three firms said they will fight the lawsuits vigorously. HCL Technologies did not respond to messages and mails, while Cognizant declined comment. Kotchen said he does not specifically seek out clients who are suing the Indian IT companies for discrimination, clarifying that “they come to us”. “In one case, they had another lawyer, who because of our experience, brought the case to us,” he said. His firm, Kotchen and Low has won settlements worth up to $220 million for his clients, the firm’s website states. And, has defended suits that involved claims up to $1 billion. Kotchen has experience litigating against large corporates. He previously served as a trial lawyer for the Federal Trade Commission. At the FTC, he was part of investigations into pharmaceutical companies and healthcare providers. Monetary damages are important for Kotchen. His firm doesn’t get paid unless it secure damages for their clients, he confirmed to ET. The practice, called working on contingency, is what allows employees to sue large corporates without needing to spend money upfront. The fees vary from 33% to 45% of the final settlement. It is common for law firms to specialise in class action suits that target specific industries. Legal experts are of the view that it is common for law firms to represent employees and file lawsuits in the US. “Many American law firms tend to focus on industry segments such as pharma or automobiles, representing employers in employment disputes and several focus on employee rights,” Poorvi Chothani, managing partner with immigration firm Law Quest International, said. IT executives, however, questioned the motives of the law firm. “They are ambulance chasers, they spend their time finding people (and) ask them to file suits. They are motivated and it is a nuisance to defend against them,” a senior executive at an Indian IT company said when asked about the suits.
