  196. SFIO arrests Bhushan Steel's Neeraj SinghalSerious Fraud Investigation Office (SFIO) has made its first arrest. Neeraj Singal, erstwhile Promoter & Managing Director of Bhushan Steel Ltd. has been arrested by SFIO.He was produced before Court of competent jurisdiction today & sent to judicial custody till 14th August 2018.He is accused of siphoning off funds of over Rs 2000 crore from the loans availed by Bhushan Steel Limited using more than 80 companies.The companies were used for fraudulent activities of rotation of funds through bogus loans & advances, investments, etc.This is the first time that the SFIO has arrested a person for fraudulent activities, a senior official told PTI.Singal was arrested in the national capital and has been sent to judicial custody till August 14, the official added.The probe agency, which comes under the Corporate Affairs Ministry, got powers to arrest people for violations of companies law last year.Bhushan Steel is one of the 12 big cases that had been referred for insolvency resolution. The company was referred to NCLT last year after accumulating a debt of over Rs 50,000 crore.In a series of tweets, the Ministry of Finance said fraudulent activities contributed to the company becoming insolvent.

ONGC, and not the government, is the promoter of Hindustan Petroleum Corp: Dharmendra PradhanNEW DELHI: Oil and Natural Gas Corp (ONGC), and not the government, is the promoter of Hindustan Petroleum Corp, Oil Minister Dharmendra Pradhan has clarified following confusion over who the real promoter of the state-run refiner was. ONGC paid Rs 37,000 crore to buy the government’s entire 51.11% stake in HPCL earlier this year but the latter has refused to recognize the state-run explorer as its promoter in public filings. In the company’s shareholding details submitted to the stock exchanges, HPCL has listed the President of India as the promoter with zero share in the company while ONGC is listed as ‘public shareholder’. “Today it’s ONGC. Don’t go into technicality. ONGC has invested in it (HPCL),” Pradhan replied to a query on who the HPCL’s promoter was.On Wednesday, HPCL chairman Mukesh Kumar Surana had said the company was being guided by the rule book on classifying promoter in public filing. "Whatever we are doing, whatever we have done and whatever we will be doing will be as per our understanding of the statute and the guidelines and Companies Act and the SEBI guidelines,” Surana said. ONGC has also recently written to HPCL, warning them of the risks associated with not recognising the majority shareholder as promoter and advising the refiner to quickly correct public filings in this regard. HPCL executives argue that HPCL’s case is special since it’s a public sector company and its board is appointed by the government, and not ONGC. Since ONGC can’t appoint the board, which ultimately controls the company, it can’t be listed as the promoter, they said, adding that HPCL can’t be compared with other subsidiaries of ONGC such as ONGC Videsh or MRPL since its acquisition earlier this year was made with the condition that it’s independent identity will be retained, they said. But ONGC executives say majority ownership automatically makes it a promoter of HPCL and even the HPCL chief should no more hold the position of Chairman as group companies can’t have more than one chairman. At present, ONGC’s finance chief is the sole representative of the company on the HPCL’s board.
