  • By Sandeep ShuklaThe Supreme Court verdict, responding to 27 petitions against the ‘draconian’ nature of Aadhaar, has been a mixed bag. While the majority opinion of the five-judge Constitution bench has addressed many of the concerns that had been repeatedly raised, the single dissenting opinion needs to be considered very seriously.The judgment’s most welcome part is the scrapping of Section 57 of the Aadhaar Act, which allowed private entities to use Aadhaar for verification purposes. Far too many people have been duped into opening accounts in mobile phone payment banks while being forced to conduct an e-KYC (know your customer) procedure with Aadhaar for their SIM (subscriber identity module) cards. This was an ethical and legal violation of even the existing Article 57, leading to abuse as serious as the redirection of LPG (liquefied petroleum gas) subsidies. The abolition of Section 57 should stop such abuse.Section 47, one of the most illogical parts of the Aadhaar Act â€" which deprived citizens of any right to file an FIR against anyone violating his or her privacy by illegally using his or her Aadhaar number, or via any other fraud â€" has also been struck down. The Unique Identification Authority of India (UIDAI) wanted this authoritative power to rest solely with itself. It had also used Section 47 against journalists and ethical hackers who had demonstrated security and privacy lacunae in the Aadhaar ecosystem.Now, citizens have their democratic right to seek redressal directly for such violations.Another positive move is the Supreme Court declaring the mandatory use of Aadhaar for school admissions, and entry into educational entities such as University Grant Commission (UGC) and National Eligibility-cum-Entrance Test (NEET) institutions, to be invalid. One of Aadhaar’s most disturbing features has been that so many disparate institutions, including schools and universities, possessing Aadhaar data and biometry have very weak security for their IT systems. They are easy targets for hackers in search of a treasure trove of data.Even though the data at the Central Identities Data Repository (CIDR) may be safe â€" and kept behind a ‘13×5 ft wall’, as claimed by the attorney general during the Aadhaar case hearing before the Supreme Court â€" the ecosystem has been leaking, is poorly protected, and any data store seeded with Aadhaar data has potential points of vulnerability.So, minimising the use of Aadhaar in private sector businesses and institutions will reduce the risk of identity theft and other forms of forgeries.Where I strongly disagree with the judgment is the majority opinion that Aadhaar’s security and privacy measures are adequate. Far from it.A few weeks ago, hackers were found to have created 26 patches to the Aadhaar enrolment software. This would allow the GPS (global positioning system) tracking the device’s location to be disabled and bypass the need to authenticate the enrolment operators by running the image file of the operator’s biometric.In effect, an enrolment station could be set up anywhere in the world. The original intent of the software was to have the device GPS-locked, so that no one could operate an enrolment centre outside India. What became clear was that with a copy of the enrolment software along with these patches, one could run the enrolment operation anywhere in the world.So, as a banker or a telecommunication operator, if you feel that authenticating someone through Aadhaar is good enough proof of the person’s identity, you are mistaken. After the news of the latest breach came out, the UIDAI had claimed that their de-duplication software is so precise that no one person can create two Aadhaar numbers. But that was not the attack model exposed in the news story.The accuracy of the de-duplication software is not 100%. With more than one billion people, even a 1% lack of accuracy can lead to many duplicate Aadhaar numbers. The fact that the database may already contain data of people outside India who do not meet the criteria of having an Aadhaar should be considered as a serious problem.Poor applications designed for using Aadhaar authentication for e-hospital application, and other such exposés, bust the claim that by identifying everyone, the Aadhaar system reduces fraud.The verdict includes many welcome aspects. But going solely by the news reports I have read on Wednesday’s verdict, I agree with Justice D Y Chandrachud’s dissenting view that Aadhaar continues to pose a “grave threat to privacy, liberty, autonomy”.The writer is a cyber security researcher and faculty member, IIT Kanpur
  • With the government imposing customs duty on aviation turbine fuel, airlines are likely to pass on higher costs to passengers as peak travel season is round the corner.Rising fuel prices, intense competition and inability to pass on spiralling expenses have been negatively impacting the domestic airlines. The latest decision to impose 5 per cent customs duty on ATF, which is a major component of an airline's operational costs, would add to the woes, according to experts.In recent weeks, airline industry has indicated that air ticket prices could go up in October when the peak travel season begins.Travel portal Yatra.com's COO (B2C) Sharat Dhall said the imposition of 5 per cent customs duty on ATF is bound to have a "negative impact" on the carriers."However, the silver lining to the situation is that with the peak season kicking in, we are likely to see increase in prices and strong loads as well. This would provide relief to the airlines," Dhall said.On Wednesday, the government raised import duties on ATF and 18 other items, as it looks to check the widening current account deficit.Grappling with soaring costs, airlines have been seeking reduction in taxes and duties related to the aviation sector.On September 10, SpiceJet's chief Ajay Singh indicated that fares could be hiked in the next few months."It is also important that we increase yield and pass on some of the costs increases to the customers. We hope that can happen in the next few months," he had said.Generally, yield refers to average fare paid per passenger.On September 4, IATA Director General and CEO Alexandre de Juniac said the steep rise in fuel prices and fall in the rupee value are putting "acute pressure on profits" of airlines in the country.The International Air Transport Association (IATA) is a grouping of more than 280 airlines.
  • Tata Steel is likely to put in Rs 300-400 crore in FY20 into Usha Martin's specialty steel division that it has agreed to acquire, to further improve the operating margins, a report said Wednesday.In one of the largest debt resolution case outside the NCLT, the Usha Martin (USL) board had on September 22 signed an agreement with Tata Steel (TSL) to sell the Kolkata-based firm's steel and wire rope business for a cash consideration of up to Rs 4,300-4,700 crore in a slump sale.USL's Jamshedpur-based steel division has one million tonnes per annum (mtpa) of alloy-based manufacturing capacity in the long products segment."TSL will help in improving the blended EBITDA/tonne (operating margins per tonne) of the acquired business to Rs 8,000 per tonne by FY21, from the current Rs 6,800 per tonne on the back of captive coal supplies, optimisation of sales mix and other operational synergies," India Ratings said in a report.It expects the acquired division to contribute a modest 3.5 per cent to TSL's absolute EBITDA in FY20 for domestic business.The rating agency also assumes TSL to incur an additional Rs 300-400 crore of capex in FY20 to further improve the division's EBITDA/tonne.The agency expects total cash outflows on account of capital expenditure and acquisitions to remain below Rs 9,000 crore in FY19, with a large portion of the acquisition outflows to occur only in FY20.India Ratings said that the acquisition is credit neutral for TSL, adding that proposed acquisition will lead to a modest increase in TSL's net leverage to about 4.0x in FY20, against 3.3x in FY18.It can be noted that global rating agencies S&P and Moody's Tuesday had said the purchase is credit positive for TSL as it widens its product portfolio to the high margin long products segments, where the Tatas are not strong now, without impacting the company's financial profile or leverage as the deal will be an all-cash one.India Ratings also said the proposed acquisition appears to be a good strategic fit to TSL, aligning well with its existing location and vicinity of captive iron ore mines. The iron ore and coal mines are adjacent to TSL's existing projects, located primarily in eastern India.It will increase TSL's India capacity to 19.3 mtpa, from 18.3 mtpa, making it the largest steel company by domestic production.It expects revenue contribution from TSL's long product division to increase to about 22 per cent by FY20, compared with 18 per cent in FY18, of the domestic sales in the near-to-medium term.
  • NEW DELHI: Hindustan Unilever and Nestlé plan to selectively increase prices of their products to take into account higher crude oil and petrol costs, the rupee’s depreciation against the dollar and more expensive commodities such as wheat.“If crude remains where it is and if the rupee has depreciated, of course there are headwinds as far as costs are concerned,” Sanjiv Mehta, chairman of consumer goods giant HUL, told ET on Wednesday on the sidelines of the 45th national management convention of the AIMA. “There will be some price increases, though we will keep the price-value equation intact.”Suresh Narayanan, chairman of Nestlé India, the country’s biggest packaged foods maker, also said price increases are on the cards. “Headwinds on commodities have already started and with the combination of the depreciating rupee and spiralling oil prices, we would take up prices selectively in some categories,” Narayanan told a media roundtable at the company’s headquarters in Gurgaon. Nestlé India’s logistics providers, too, are looking to renegotiate rates after record-high petrol and diesel prices. Mehta declined to comment on when and by how much prices would increase. “We don’t indicate pricing guidance. Price increases would not be basis a one-to-one correlation with input costs and we will keep the price-value equation intact. We are always circumspectwhen it comes to a pricing decision,” he said. Mehta said HUL had dropped prices in November after the Goods & Services Tax was introduced last year and an increase in prices now would likely not hurt consumers.“Even if the price goes up now because of input costs and the devaluation of the rupee, we believe the consumer will be cushioned,” he said. ET reported in its September 7 edition that prices of daily consumption products would increase by about 5% starting the third quarter, citing companies such as Britannia and Parle Products. The impact of the minimum support price â€" guaranteed by the government to farmers â€" has been in the range of 10-12% and is in itself steep, the companies said.However, not all companies will pass on the entire burden to consumers because it could hamper growth. “We will try and ensure that price increases are selective and growth doesn’t get impacted,” Narayanan said.On the consumption outlook given the inflationary environment, Mehta said: “Market consumption does not change overnight. Definitely the market bottomed out when we saw a period when we had two consecutive years of drought to now, when volume growth has moved up.”Petrol prices have crossed Rs 90 a litre in Mumbai on increasing global prices of crude oil, of which India is a net importer, further impacted by the falling rupee. Crude derivatives, which are key inputs for FMCG companies, and petroleum derivatives used in packaging material including bottles and tubes, have also become more expensive. However, Mehta said farm loan waivers and GST augur well for consumption, especially in the rural areas.
