The local currency has fallen more than 12 per cent on a year-to date basis, making it one of the worst-performing currencies among emerging markets.Earlier in the day, the rupee resumed higher at 71.65 against yesterday's closing of 71.75 the interbank foreign exchange market. A Reuters report said that the Reserve Bank of India was not spotted intervening after the rupee pierced the 72 level. Do you think it is time to buy a bank, do you see a decent digital revolution in some of the new banks that they are claiming and indicating now?If we believe that history will repeat itself then there is a clear success story of a particular NBFC from western India. They adopted technology like no other company adopted and for the last almost a decade from a really low point in their career, they have created enormous wealth for the shareholders. While there are many contributing factors for that spectacular success, to a great extent, it can be attributed to their ability to ride technology in blending their business, in creating a niche for themselves which others fail to exploit. That example should serve as a lamppost, as a guidance and companies across the sectors which blend technology and digital revolution to disrupt existing business model to dis-intermediate intermediaries, to provide products and services which enhance value to the customers, will be the winners in this game. We have to find out companies which are riding the wave of disruption rather than which is getting under the wave of disruption.Do you expect corporate banks to do well? Could there be a bottom in place around the corner?Many of the corporate banks have already moved up by 25-30% over the last couple of fortnights and this is on expectations that the NPA cycle is behind us and the good days are coming for corporate banks. This is a case by case rather than sectoral call. There are some corporate banks where hopefully NPA cycle is coming to an end over the next one or two quarters. We believe there are a few corporate banks where the NPA cycle is not coming to an end. They will have to provide further NPAs in the power sector. They will have to provide further NPAs in SME sector and I want to particularly highlight the SME sector where credit flow is getting restricted. Eleven out of 21 PSU banks are under PCA. They cannot lend money unless and until your rating is highest. This along with six other PSU banks which are not under PCA but which have probably adopted voluntary PCA, contribute to a substantial size of banking balance sheet in the country. Their credit flow is restricted to SME segment and that is creating a kind of choke-up for the SME sector and could result in higher NPAs going forward. You have to be careful with corporate lending banks. It a bottom-up stock selection rather than top-down sector call, especially after last 25-30% run.You mentioned case by case, but in the digital space, the way to evaluate the opportunity is really going to be business model per business model. Disruption will actually slow down growth for most obsolete players. How are you looking at opportunity within the digital segment?This is a case where if you are looking for market outperformance by and large over next four-five years and have companies that are disrupting existing business model, they are likely to be the winners. Companies which are allowing their business to be disrupted are likely to be the losers. Digital disruption, technological revolution, they will have to be measured on a case by case basis. The past laurels will not be sufficient. There might be a start-up in a remote part of India which is already creating a model which will disrupt the giants. This is a fight between David and Goliath, obviously size alone cannot guarantee you success.India has always been a big consumption story. Of late, one is getting the sense that global brokerages are downgrading stocks like a Unilever, Britannia etc. Do you think some profit booking or shifting is advised in high PE consumer durable names as they have run up so much already?From a trading point of view, it might be so, but from a long term investment point of view, we still remain bullish on consumption sector. Maybe, it is worth rotating money from high PE highly valued consumption sector stocks to reasonably priced consumption stocks. Some amount of sector rotation might be worthwhile. We might see some shift coming from higher PE to lower PE stocks. We might see some shift coming from urban focussed consumer stocks to rural focussed consumer stocks. That sector rotation will be seen in consumer related stocks.

  752. In a historic verdict, a five-judge Constitutional bench of the Supreme Court Thursday, in four separate but concurring judgments, legalised same-sex relations between consenting adults. It termed the 2013 judgment constitutionally impermissible. A five-judge Constitutional bench, led by Chief Justice of India Dipak Misra, was hearing a clutch of petitions challenging Section 377 of the Indian Penal Code (IPC). Today's verdict comes on five petitions moved by dancer Navtej Jauhar, journalist Sunil Mehra, chef Ritu Dalmia, hoteliers Aman Nath and Keshav Suri and business executive Ayesha Kapur.

  1761. Banks weren’t the only victims of fugitive jewelers Nirav Modi and Mehul Choksi, who allegedly orchestrated a $2 billion fraud. India’s trade may be an unsuspecting casualty.As the fraud unraveled, the central bank stepped in and banned short-term financing in foreign currency called Letters of Undertaking to limit the damage to the financial system. The result was the cost of funds for exporters and importers rose as the industry was forced to seek new credit tools, said Ajay Sahai, director general of the Federation of Indian Export Organisations in New Delhi.The worst hit are the smaller enterprises as the ban is eroding their margins and competitiveness. Trade credit is tough to secure after jeweler Modi used fake letters to obtain loans in banks abroad. That threatens to choke shipments of gems and jewelry -- the nation’s third-biggest export -- and widen the trade deficit, which is already the biggest in five years mainly on account of higher oil import bill.Total gems and jewelry exports in the April-July period fell by 1.5 percent from a year ago to $13.7 billion, while imports of precious stones -- a key input for exports -- dropped by 19.5 percent to $9.84 billion during that time.“The banning of LoUs was a serious blow,” said Amitendu Palit, a senior research fellow at the National University of Singapore. “It is not just jewelry exporters that have been affected, but others also. An alternative must be found, such as allowing LoUs with safeguards.”That view was echoed by a Parliamentary panel, which in a report last month sought restoration of the trade finance tool at the earliest. The Reserve Bank of India “got unnerved” by the fraud at Punjab National Bank and the ban was a “knee-jerk reaction”, it said, while flagging risks for cost competitiveness of trade and the cascading effect on jobs.Biggest Bank FraudThe panel was referring to the $2 billion bank fraud uncovered in February at India’s state-owned Punjab National Bank, which accused Modi and Choksi of defrauding it. The duo have fled the country and are wanted by Indian courts under a new law on fugitive economic offenders that allows authorities to confiscate their assets.Though traders still have access to other forms of trade finance such as bank guarantees and letters of credit, the ban on the interim guarantees increases their borrowing costs by about 200 basis points and comes at a huge cost for small traders.“We all are paying the price for what Nirav Modi did,” said Pradeep Goyal, who runs a metal trading company Agsons Agencies (I) Pvt. “We have spent many sleepless nights over this. My cost has gone up, my cycle has reduced and I’m feeling the crunch.”

Scrap dealers enquire about idle powerlooms.India launched the Goods and Services Tax (GST) just over a year ago, its biggest ever tax reform, aiming to replace more than a dozen federal and state levies and unify the sprawling economy.The move improved economic efficiency but critics say the complexities of the new regime have driven many small enterprises out of business and forced hundreds of thousands out of jobs.For Prime Minister Narendra Modi, the drawbacks of the GST, especially the job losses, could prove costly in major state elections later this year and a general election in mid-2019.Bathla says his neighbours, most of them unschooled, could not comply with monthly online filings required under the GST regime. Some of his customers and suppliers could not afford to hire accountants to navigate a system which has been amended more than 200 times already, while others struggled to cope with delays in tax returns caused by glitches in the centralised software."I have a GST registration, but I can't work as my vendors and buyers are unable to comply with a complex tax structure," the 50-year-old said, adding his monthly sales had fallen to about 250,000 rupees($3,511) from about one million rupees before the GST. Only two of his 10 powerlooms are currently being used.The government has said it is simplifying the tax measure to make it accessible to everyone. Finance Ministry spokesman D.S. Malik said requests from small businesses have been considered "from time to time." But he declined to comment on job losses.Nevertheless, India's economy gathered pace in the April-June quarter, expanding 8.2 percent compared to 5.6 percent in the same period a year earlier. Economists said the number was coming off a low base as companies held off production in the year-ago period ahead of the implementation of the tax measure in July last year.But while big firms have since shaken off the effects of the change and are set to gain from a uniform tax regime, small businesses across the country are still hurting.A survey by the All India Trade Union Congress (AITUC) in July found that a fifth of India's 63 million small businesses â€" contributing 32 percent to the economy and employing 111 million people - faced a 20 percent fall in profits since the GST rollout, and had to sack hundreds of thousands of workers.Readymade garments, gems and jewellery, leather, handicraft and basic machinery manufacturing are hit the most, industry bodies from across the country say.According to estimates by the Centre for Monitoring Indian Economy, a Mumbai-based consultancy, nearly five million workers lost their jobs over the past year. But it was not clear how many were from small enterprises.India's unemployment rate rose to 6.4 percent in August from 4.1 percent in July last year despite an additional 17 million people joining the workforce.But it did not give data on how many people were laid off or from which industries.India's labour ministry releases jobs data once in five years, last reporting unemployment at 5 percent in 2015/16 (April-March).More than 50 workers and factory owners Reuters spoke with in Panipat, about 90 km (55 miles) north of New Delhi, said over a third of the city's 10,000 weaving units had closed or curbed production.Chand Multani, president of the Panipat Handloom Owners' Association, pointed to the tax headaches behind a bedsheet that costs barely $2 dollar as an example.The weaving of the sheet, its dyeing, ironing, embroidering and packaging are all done by separate businesses. Under the new system, each business has to pay GST at each stage of production which the businesses can claim back provided they have registered with tax authorities and have a GST number.For a lot of small businessmen this is way too much work. "How can all these different operations comply with tax rules?" asked Multani, waving the sheet in the air.The GST replaced several federal and local taxes and tore down tariff barriers between India's 29 states, but critics say that has been to the benefit mainly of large, nationwide businesses.For Panasonic Appliances, India's leading electric goods maker, GST has meant cutting costs by 4-5 percentage points, for example. India's consumer goods stock index has risen 26 percent in the past year, outpacing the broader Mumbai market."GST ... has improved the competitiveness of the manufacturing sector," Panasonic India CEO Manish Sharma said.Modi, in an Independence Day speech on Aug 15, said the businesses that faced "teething difficulties in adopting GST had accepted the challenge and the country is now moving ahead."But Rahul Gandhi, his main challenger in next year's election, has zeroed in on the job losses and shuttered businesses."This GST is a way of removing money from the pockets of the poor," he said last month. "This is not GST, this is Gabbar Singh Tax," he said, referring to the villain in one of Indian cinema's most popular movies.Modi's popularity fell below 50 percent in July from 53 percent in January, while Gandhi's rose to 27 percent, up from 22 percent, according to a survey by India Today magazine. Eighteen months ago, the score was 65 percent to 10.To address grievances, the GST Council, which administers the tax measure, has approved more than 200 amendments since the law came into force.MS Mani, senior partner at Deloitte, said too many changes to rules and rates were damaging, particularly for small businesses.The Federation of Indian Export Organisations estimates that nearly $2 billion of tax credits, mainly of small exporters, were yet to be refunded, mainly because of software glitches in the system and the difficulties in matching the hundreds of thousands of invoices.About 230,000 small businesses have closed down due to compliance and cash flow problems, leading to large-scale job losses, said Amarjit Kaur, national secretary of the All India Trade Union Congress."GST has proved a death warrant for us," Ravinder Kashyap, 22, who lost his job as a powerloom operator earlier this year, said in a small rented room in Panipat that he shares with four friends.He said his employer had lost sales orders because of the mess caused by the tax and so had let him off along with scores of others. Seats are available to buy on ba.com from today, for travel from September 27, 2018,” said a release from British Airways.The agreement means that British Airways customers will now be able to visit 13 new destinations across the region, opening up cities such as Ahmedabad, Amritsar, Bhubaneswar, Chandigarh, Goa, Kolkata, Kochi, and Pune that have previously been more difficult to access from the UK.With this partnership, British Airways customers travelling on the codeshare flights will be able to check their bags straight through to their final destination and both airlines use the same terminals at Delhi and Mumbai airports, making it even easier for customers to connect on to domestic services.British Airways operates two direct flights a day from Heathrow to Mumbai, a double daily service to Delhi and a daily flight to Chennai.   1764. New Delhi: The National Company Law Tribunal has ordered Malvinder and Shivinder Singh to maintain status quo of directorship and shareholding in their holding company, RHC Holding Pvt Ltd. The tribunal was hearing a case by Shivinder Singh against his brother and Sunil Godhwani, the former chairman and managing director of Religare Enterprises, alleging oppression and mismanagement of RHC, Religare and Fortis.Meanwhile, the Singhs have been granted permission to inspect the books of RHC along with their company secretaries and chartered accountants. The Singhs are the only two directors of RHC and together hold 100% stake in the company.In his petition, Shivinder Singh has alleged that RHC Holding had taken more loans than it could pay up through inter-corporate deposits (ICDs), said a lawyer present during the proceedings on Thursday."It has destroyed a company worth Rs5,000 crore," argued Shivinder Singh's counsel at the tribunal.Ranjana Roy Gawai, Managing Partner of RRG & Associates, the law firm which filed Shivinder Singh's petition at NCLT, refused to comment on the grounds that the matter is sub-judice.The status quo order was granted as an interim measure after Shivinder Singh's counsel asked the tribunal to prevent the sale of any shares in RHC by his brother. The tribunal will hear this case next on October 9.Malvinder Singh and Godhwani are expected to file their reply to this suit within 10 days, following which Shivinder will be granted time to file a response to their affidavits.

Will this emerging market slide have impact on portfolio investments in India? Clearly it is a tricky situation, where one part of India is witnessing dramatic correction. Rupee is down more than 4% in August alone. 10-year interest rate is up about 33 bps in August. On the other hand, equity market in index term is near all-time high. Clearly, from an FII point of view, they will be in two minds â€" one, should they look at the improving micro situations in India as is evident from the quarterly results or should they worry about deteriorating macro situation where oil prices are higher, rupee has weakened, interest rates have risen and which ultimately could have impact on growth. It is a tricky situation where FIIs hopefully will take a call on a longer term basis looking at the fundamentals of companies in which they are investing rather than taking a top-down view. A lot is happening with Sebi in terms of the FPI money from NRIs. What do you think is the impact of this and is this a big issue? All kinds of numbers are floating around -- $75 billion, $80 billion. Undoubtedly if the FIIs believe that their investments in India is not welcomed, they will take a different view. But the good part is that The Securities & Exchange board of India (Sebi) has clearly communicated that they are keeping concerns raised by the FIIs in mind. Anyway, the deadline is 31st December and there is no pressing hurry to do it tomorrow. This is an issue which can easily be resolved through consultation because on one side, FIIs have clearly said that they have no problem with the disclosure and on the other side, Sebi has mentioned that they are not in favour of restricting someone’s ability to do a business. They just want to ensure that there is no round tripping. The he objective is the same. How one arrives at a way to achieve that objective should be easily approachable. Do you think India will be isolated or be a different market as earnings growth is showing the first signs of decent improvement. Do you think we are not that decoupled at all? My hope is we would be in a better position compared to 2013 to withstand a global shock. In 2013, taper tantrums created a shock but at that point of time, macro India was fragile, inflation was in double digits, the current account deficit was upwards of 4.5% and fiscal deficit was almost higher than current account deficit. Clearly that was the time when India was also going into elections after a year. Put all these things together, we were in a far weaker situation at that time. Today inflation is rising but it is rising from lower single digit to mid single digit; fiscal deficit is likely to overshoot the budgeted number but it is on a much-much lower base; current account deficit is rising with higher oil prices but it is still way below what it was in 2013. So, we have a slightly deteriorating micro situation vis-à-vis current account deficit, fiscal deficit and inflation but it is significantly superior to what it was in 2013. More importantly, between 2013 and 2108, we have taken certain steps which will create a good platform for economic growth in the future. GST has been introduced and rolled out. It has made India one nation, one market. The demonetisation benefits are now visible with higher digital payments and better tax compliance. The government has also built infrastructures in terms of road, railways, solar capacity and so on. Put together, today we are far better than in mid 2013. Second, corporate India is looking at the future far more positively than they were in 2013. Therefore, despite higher oil prices, higher real interest rates and a weakening rupee, we have a reason to be optimistic about corporate earnings growth in the rest of the financial year. For earnings to recover in a big way, the capex cycle needs to pick up. Do you think this is around the corner or is it going to be another long wait? There is a slight differentiation. If you look at the IIP series and the GDP growth, capex seems to be recovering. But when we talk with the management in listed segment, we are not seeing significant recovery in capex. Clearly, capex is coming in the non-listed segment, in real estate. Looking at industrial recovery means we are seeing investments in sectors like power where there is surplus capacity. So, it is a little further away. But will there be investment pickup led by the government spending in infrastructure like roads and railways or a pick up in real estate sector by virtue of rural demand? The answer is yes. We will see one part of investments related to government and rural India doing well but the industrial capex is a little further down the line. What is the view on midcaps and smallcaps? How do you look at the valuations there now that largecap valuations are seeming a bit stretched and the overall price points at which midcaps and smallcaps are available? My feeling is that after the corrections from Jan 2018 level, midcaps have become worth looking at it. But clearly, over next 10 months, we expect markets to be highly volatile. It will be volatility partly because of global factors: a) interest rates in US are rising. B), Liquidity injection across US, Europe and Japan is slowing down. C) A tariff war is raging between US and China and India could have see collateral damage. Most important for us, oil prices are on their way up. From $40-60 a barrel, it has gone up to the $70-80 a barrel. All these global factors will have their own impact on Indian market on the way up. Second thing is valuation. Clearly there are some largecaps which are in overvalued category and finally, the political scenario. In May 2019 general election, if India votes for a stable government committed to reforms and growth, markets will be fine. But if we end up getting a coalition government which is not committed to growth or reform, there will be adverse reaction from the market. So over next 10 months, there will be enough opportunity for you to invest on a correction. This is not the time to chase the prices. This is not the time to do momentum investment. This is the time to build portfolio on correction. In such a market place, do you think the best place to hide are export stocks? With the sort of currency move that we are seeing right now, should pharma and IT hold higher weightage in portfolios? If you are taking a shorter term view, then yes IT, pharma, blue chip, largecap companies, defensive companies are the place to hide. If you are taking a longer term view, then you have to invest in companies which are using technology to disrupt the business models in various sector. Today we are at the cusp of digital and technological revolution just like we were in 18th century for industrial revolution. During industrial revolution, India missed the bus and partly because of that along with colonisation, our share in global GDP came down from 25% to less than 1%. Today world is at the cusp of digital and technological evolution. We should not miss the bus and if we miss the bus, there will be adverse consequences. It is not only technology and pharma where digital and technology is creating disruption, it is even in a commodity sector like textiles. Companies which will be agent of change, which will be harbinger of digital and technological revolution will outperform the market that is where investor will make money.
